The tricky thing here is that marriage (and divorce laws) are all on a state by state basis, so much of the answer could depend on whether your state really recognizes annulments.  Maybe this will help:

If you were married outside the country, this topic might be even more complicated.

I'd definitely plan on filing I-751 with the standard divorce waiver.  If she's claiming the marriage is void due to mental illness, that's not obviously fraud.  In any case, your situation sounds like it's one that would benefit from a skilled immigration lawyer as it's likely going to depend on subtleties of state-level law.

Ok here is the update of my case .

I went to immigration lawyer today and she is really professional one . She contacted with my family lawyer and we got the settlement.  The Annulment saying (( The Court finds that the marriage between the parties, while entered into in good faith, is voidable and subject to annulment becausePetitioner lacked the necessary mental capacity at the time of the marriage. The Court, therefore, finds that the marriage of....... and ........... is voidable and should be annulled as prayed for by Petitioner. ))

 I signed it today.

so what y'all opinion about that ? Can I roc with this annulment?
