Got an RFE and we marked the wrong box

Yeah, they sent the RFE because we forgot to mark either box, so I hope by sending the records and marking the right box everything goes well.

You can either fix the current one or provide a a new copy of the page(s) with the corrected information. Either is fine..they just need a complete and correct form.

You can download and print the form (https://www.uscis.gov/sites/default/files/files/form/i-129f.pdf).

 

As noted, provide documentation of the case as well.

With the RFE they just send a page on which the missing question was printed, so we are just going to white-out that and send it with all the documents.

What you are saying seems really severe for just forgetting to mark a box, but then again the whole process is not to be taken lightly. I think we will call USCIS and see what can they say about the form.

 

Hopefully, they can understand it was an honest mistake (especially considering the crime) and our application isn't denied.

 

Also, when my fianceé got a background check done that charge didn't pop up, so I don't know why would it since it has been expunged.

It is very confusing - did you forget altogether to mark the box, or did you mark "no" when the correct answer was "yes"?

I'm with @Jorgedig on the confusion. If OP can clarify a bit; OP might already have but I didn't see it so my apologies in advance.

1. Did you send the original application with the question not answered at all, and that's why you got the RFE?  Then you filled it, and realized you filled it wrong so now you are trying to correct it?

2. Or you sent it with the question answered. But you got RFE for something else and realized that question wasn't answered correctly so you are trying to change it in addition to the requested RFE?

OP clarified it already. On their original submission they did not check either yes or no, hence the RFE for not answering all the questions on the I-129F form.

Never use whiteout on a legal form.  Certainly do not use whiteout on the RFE from the USCIS. 

Really? Whiteout? Even if you incorrectly marked the wrong box the correct way would be to check the correct box and initial the correction.  

You said she marked no.  Then you said she marked neither box.  Which was it?

Neither on original form. No on RFE.

I got guidance, but some people said yes to white out, some are saying no...

Exactly the same thing happened to us, we forgot to answer the question on the I129F, and on the RFE letter my fiance rushed to check the NO box and he had 3 MIPs.

 

Well, he put tip-ex on it and checked YES instead, we did include an statement letter repeating the question and being as clear as possible that the answer was YES. We also included all we could find about those 3 MIPs. 

 

We got approved after 2 weeks of sending the answer back to USCIS.

This was not that long ago, so I think we are going to do this.

I had a 30 year old arrest that was dropped and expunged.  I answered no at the recommendation of RapidVisa.  We were denied because I failed to disclose information in the petition...That is my story of answering 4a wrong.  Maybe you can bring it up to the CO during the interview.  We were denied after the interview during AP.  They took my wife's and step-kids passports and returned them with the denial letter.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
