WAIVER I need help!!!

Hello, I’m so confused please I need your advice, two years ago my tourist visa was cancelled because I worked 3 times in six months, now my I-130 is about to become current and I need to know if I need to file a waiver to continue with the process in the embassy, I’m not living in the states, my visa was canceled and I had an expedited removal and I am inadmissible for 5 years, do I need to apply for the waiver even if the process is not to obtain another tourist visa? It’s for my residence, thank you

Yes, a standalone I-212 is necessary if you reapply for a visa within the 5 years due to the expedited removal.

Yes, the inadmissibility applies for any visa.

Hey can I ask something? Working 4 times on tourist visa do u think doest it effect your interview or they will deny u at the time of interview??? What document will u show if they ask or what reason will u give them please i want to ask for my knowledge!

You are family based off LPR? There is no forgiveness for violation of status. Remember you have to be honest in your interview. I’d say you should be prepared for problems. There is no “reason” for breaking immigration law.

I didn't work there i am asking for my knowledge as I mention. .. he have done that that's why asking what he thinks he will face on interview could be a deny or some documents etc.

Who is “he”? OP said 3 times and you said 4 so I assumed you were talking about yourself. Are you asking just out of interest, hm? Remember OP also had expedited removal, are you interested about this too?

 

as boiler says LPRs are eligible for waivers. Is that what you mean by “some documents”? To get a waiver you have to be interviewed, denied, and informed you can apply for a waiver. The waiver takes some months to process and may or may not be granted.

My question is still not answered.. i did a typing mistake wrote 4 instead of 3.. My question is working on visit visa 3 times, breaking a law and it's called illegal activity on b2.. does it effect immigration? is op i130 approved and processed like a normal case what op will face on interview it will be a deny or they will give her visa? What is waiver as I don't know about it. These are my questions! But thank you for your replies..

I did answer originally that it’s a violation of status. If you don’t understand what a waiver is, google it. If you have a specific question that pertains to your case I am sure people will be happy to answer. We all give of our own time for free to help people who need help. Answering hypothetical questions and things that can be googled is a different story. Thanks.

Unauthorized work in itself is not an inadmissibility.

A removal is in inadmissibility requiring a waiver.

 

If you have a specific question about you circumstances, please create a separate thread, describe the circumstances, and somebody can provide a better informed response without cluttering somebody else's thread about their circumstances.

So, I need to file the waiver as soon as I get my approval or after the interview I’m the embassy?
