N-400 Denied (anyone who intends to file the day they become eligible, read this)

The credit card that I used for the application has email notification for purchases >$200. I received the email with the same time stamp as the N-400 receipt email confirmation.

 

If this were Cincinnati, OH where I can probably get an interview in 3 months, then I would just apply again but to wait 1 year for interview and then to get denied for a glitch in the system? It's not even your fault.

Sorry to hear Hypnos, that is some bollocks right there. Either you become eligible 90 days prior or you don't, that shouldn't be open to interpretation by a computer or a confused officer. I hope they put this right. 

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I submitted the day i became eligible by 2:22PM (EST) according to the email i received but the transaction date shows 10:22:13AM... which is 4 hours behind EST(my time). The only place i know EST time is 4 hours ahead is Alaska. IF this is infact true..there is no explicit mention of this on the USCIS site so @Hypnos can indeed make a case for this.

Here OP applied on 90th day and that is hard fact. So I still can not fathom how USCIS is blindly saying that OP applied one day early.

I would also suggest getting an Infopass appointment for this, and bring all the paperwork proving you filed on the proper date, including the denial letter---if the infopass appointment is in the same field office where you had your interview, and the IO or their supervisor is available to speak with you, you may be able to resolve this on-the-spot...

All of the steps you are mentioning are good, but I would want to be in front of someone from USCIS ASAP.

Time and days are relative to the person’s location.  I am not making excuses for USCIS, but it is a simple fact that the day in one place is not necessarily the day in another place, and computer systems use clocks that may be set to different time zones.  That being said, I hope that @Hypnos receives a positive resolution to this issue especially considering your own experience.

So sorry for your case. I submitted my N400 online at the first day I could as well, but I did it in the afternoon. I was approved and now waiting for my oath schedule. Hopefully your case can be resolved.

Hello Hypnos, 

 

Sorry to hear that your application was denied. Actually, I have also submitted my naturalization application in the early hours (1:00 am EST) of the day  I became eligible. I completed my interview and interviewing officer told me that they could not make decision at that time because of some "timing issues". I have been waiting for the decision for more three months. 

 

Hope your congressman can help you. Please keep this thread posted so other can benefit from your experience.

To give a couple of minor updates. Last week I spoke with an immigration attorney that I trust (not a fly-by-night), that actually helped me get my green card way back when. I gave him all the details and asked for his expert opinion (and offered to pay since I had no intention of freeloading off him). He contacted pay.gov, the federal agency that processes electronic payments for dozens of other federal agencies, including USCIS. He asked for full details on my payment to them, and since they typo'd in their response to him I contacted them directly again (and they made the same typo). They clearly indicate that my payment was processed at ~3:32am Eastern on 1/3/18, so this lines up with my AmEx receipt and ELIS receipt, both of which indicate the same time of 2:32am Central on 1/3/18.

 

The lawyer's email to me contained the line "They are clearly wrong on this."...

I am expecting to hear something through my congressman's office this week.

I feel you will get this resolved soon! The day you become eligible is the DAY YOU BECOME ELIGIBLE! No further questions should be asked.
