Based on the dates you provided, you did overstay.

Did you stay in the US for 90 days?  Or did you make the mistake of staying for 3 months?

I would second the recommendation to consider the CR-1. I went the K1 visa route, filed AOS packet in September and still waiting for work permit 🙄 If you're concerned about finances there's a massive advantage to CR-1.

 

Unfortunately there is no easy way to speed up the process. You will not be able to move to the U.S. by August. But you can plan visits over so could try plan that around the birth of your child. Just make sure you have evidence to prove you have reason to return to U.K. after your visits (lease, job, school, etc). And keep taking lots of photos from visits.

 

I wouldn't bother with a lawyer. Just take your time with paperwork. Good Luck!

Count the days just to be sure.  the CBP could stamp your passport for 6 months but as per esta you can only stay for 90 days

I can speak to erroneous stamps. My husband's passport has had the wrong date stamped in it twice on two different occasions of border crossing by CBP. It's better to double check on it and be safe rather than sorry.

It does not matter what the CBP stamps the passport for. 90 days is 90 days. You overstayed by 1 day, according to your post. We are all trying to help you figure out the best way forward OP.

Yes, I've heard this happen before too - hence the warning 😥

 

BTW according to the dates that OP gave, I used one of those online "duration" calculators and it looks like he stayed for 91 or 92 days depending on if you count the last day. He really needs to check the I94 online. I believe (but am not 100% sure) that is the official record, and if somehow CBP actually did give him until Jan 13 (94 days) then he would be okay. This needs to be verified , however!
