I-130 (CR-1) denied because USCIS lost the RFE they received.

Thank you ! I was wondering if I just didn’t understand the letter well enough / some law phrases that implied otherwise. 😊

I felt them blank on my I-129f and never got an RFE for it.

05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

I think there is a lot of hot or miss with the adjudicators. There were others here who did what I did and they didn’t get denied. It all comes down to who gets the package. 

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Timeline

Really thankful for all the opinions and advices from everyone here.

Just a slight update on my case,

(I hope no one else ends up in a similar situation but sharing just in case) 

 

After discussing our options on the it, 

 

7th feb : I-290B sent to USCIS

21 Feb : received I-130 case update (our case is reopened and is being actively reviewed ) 

 

*keeping fingers crossed they come to a favorable decision* 

 

Will update again once we get a reply. :D 

 

A little bummed seeing people that started the same time we filed receiving their visa now but we are still close to the beginning, nonetheless, just glad it’s somewhat sorted out and back on track for now. Thank you all again!

Just a brief happy update! 

It isn’t updated on the website/ system but husband received our NOA-2 approval in the mail today! 

 

The approval is dated on Feb 21, 2019! 

Surprisingly, the day they re-opened our case lol. 

(Slight mixed feelings over it cause it means someone messed up causing us to have to wait longer and spend more money for their mistake tch. Not to mention the trust issues I have with them now lol. Anyways, happy nonetheless! ) 

 

Letter says its forwarded to NVC now so back to a normal petition process. :D 

 

probably won’t be posting update onwards till we receive our visa in like 6mths or more.

Edit : reason for denial is because we didn’t reply to the RFE which they received as seen in case file update

i want to upload the picture of the denial letter but somehow it’s too large.. 

 

at this point any advice is really appreciated. 

 

Quick relationship summary

 

been (online) best friends for about 10years before we decided to meet up in 2013 and then became a couple, met every year at least twice with 3weeks-2mths each meeting (we take turns flying to each other) got married Jan 2018.

After how many days you submit the inquiry, because i wait 5 months after they received de evidence and nothing happens I want know what we suppose to do

I think we submitted the enquiry in January 2019 while the reply to the RFE was received by USCIS in October.  So it’s about 3 months/ 90 days when we submitted the enquiry. You can currently wait or submit an enquiry. The reason we didn’t wait longer was because our rfe was a silly one and all it needed was empty pages that were left out originally.

In My RFE they want the marriage certificate , the RFE was received in December 28 2018 and we respond on  January 7 2019 , January 11 uscis received the evidence after that is waiting and waiting is a little be frustrating
