She has done that. The lawyer got them to reopen her case. But the lawyer is not sounding hopeful about a positive outcome

Coming in to confirm what others have already told you. There is nothing that can be done.

She has to be in status to adjust status so no idea what she thinks she will achieve.

How long does she want to stay?

This isn't a game show where people get multiple chances to win prizes. There is only "legal" and "illegal". Your friend has put herself in a pickle by illegally staying. Unless she wants to get into even more trouble, her only legal option is to go home and for her husband to accept that he will not be able to come to the US for some time due to her actions.

Yet you ignore all these to focus on half a post (you ignore the rest of that same post) that says “get competent legal help” which she has and the lawyer is telling her the same thing as all the above. What do you think is going to happen, Trump is going to magically decree that all overstays are forgiven and granted green cards?

Hmmm

If you're hoping more people will come into this thread to give you a different option, unfortunately there isn't one.

She must return home (if she ever wishes to live legally in the US).

Her husband has 0% chance of getting a tourist visa at this point.

She has invested alot trying to resolve this issue with immigration that she feel it will be a big loss of money after spending much.

The only way she will resolve this issue is to leave the US and wait out the 10-year ban she will trigger.   That is the only resolution there is.

She has invested alot trying to resolve this issue with immigration that she feel it will be a big loss of money after spending much. The major thing she wants to achieve know is to lift the effect her process is having on her husband visa

Correction, she hasn’t “invested” anything. She’s paid a lot of lawyer fees to try do something which we could have told her for free wasn’t going to work. (We could especially have told her how dangerous it is to try change status to F1 from within the US, btw, because of the tricky timing associated with F status.)  Sorry to be harsh but that’s the simple truth of the matter.

Her existing visa got voided the day she overstayed, and she has no basis to adjust to anything else.  Her only - only- option to get the overstay forgiven would be to marry a USC, but that’s a bit difficult with an existing husband and with her immigration history screaming “green card marriage” if she tried that route.

Or wait 15 years for her kid to turn 21... if IR5 still exists at that stage...and if immigration doesn’t come knocking first.

Basically she has two choices: leave voluntarily or get deported.

She can’t adjust through anyone other than an IR category USC from where she is now. With an existing husband and with her usc kids under 6 years old, that doesn’t really give her options...

Non IR is possible but she also would have to do a I-601A waiver and/or 245i if she qualifies.

(1) those are not easy to get and (2) the only possible hopes for family sponsorship she currently has would be a USC parent or sibling, with a 13-15 year wait. There is nothing feasible here...

I’ve heard lot of I-601A get approved but the hardest part is proving extreme hardship. There are lawyers who specialize in that department.

She has a USC parent? That would be about 7 years I believe. Faster if a law passes to move the backlog faster. I remember it was 4 years wait back in the days.

Where did you get from the OP that the woman in question has a USC parent?  I must have missed that....
