IRS website states: 

Attach a statement, signed by both spouses, to your joint return for the first tax year for which the choice applies. It should contain the following information:

  1. A declaration that one spouse was a nonresident alien and the other spouse a U.S. citizen or resident alien on the last day of your tax year, and that you choose to be treated as U.S. residents for the entire tax year

IMO: When they said Identification number, I believe we can put her country’s passport number.

One of my friend filed tax with similar case  by attaching statement signed by both spouse, and attached notarized possport copy from US embassy by paying US $50 and W7 form.

ITIN was not required..

They got refund without any issues.

I think this is how we need to proceed..

you can file normally with the w7 and supporting documents included

I'm in Morocco for one more week. How can I get a copy of my husband's passport certified here? I don't want to take his passport back to US with me and I don't trust sending it to the IRS with the way things are currently.

why passport?  '

 

it is the only "stand alone" document to prove birth and  country but it is not needed

 

get a birth certificate and marriage  license and  file those with W7

Oh thank you! I didn't realize that was an option. It seemed like everywhere I was reading, a passport or a certified copy of it had to be submitted with the W7. Have any idea if regular photocopies of the two certificates would be acceptable for the IRS?

A photo ID must be included and on the list of supported documents (page 3):

There are 13 acceptable documents, as shown in the table below. At least one document must contain your photograph, unless you’re a dependent under age 14 (under age 18 if a student). You may later be required by the IRS to provide a certified translation of foreign-language documents."
