Is there a good template for an affidavit for friends somewhere ? to submit with ROC

  Thanks

 

  We have plenty of financials, family pictures from holidays, insurance et al. Are the affidavits helpful ?

Affidavits are secondary evidence.  They certainly won’t be enough on their own, but there is no harm in including them, especially for folks lacking stronger evidence, or for certain couples go need to front load the petition.

There's no real format.  The idea is that someone writes a letter stating how they know you and your spouse, how long, and why they think you have a bonafide relationship.  There's a reason why they're not great evidence.  No one says anything bad.

I googled a couple before sending them in.  As stated above they aren’t powerful evidence and I can’t swear anyone ever looked at them.

 

That said:

 

They want to state who they are, how long they’ve known you, how they know you and some statement of how you interact (we see each other weekly, I have stayed at their home, etc.) and then say that the obsservation is that they live and socialize as a married couple (or engaged couple).  State what is observed not the conclusion (say: they live together and share the same bedroom, they are affectionate with each other.  Don’t say “they’re a genuine couple and in love.  I can tell.”)

 

A quick sample:

 

My name is John Smith and Bob is my cousin who I see several times a month.  My wife and I socialize with Bob and Suzy often and I know they share a residence and to my knowledge, the same bedroom.

 

Bob and Suzy travel and socialize only as a married a couple.

Sure.  See the attached.  

 

For anyone not familiar with filling out affidavits, the top portion would look something like this:

I, Jane Doe, born on January 1, 1900, and residing at 123 Main Street in the City of Buffalo, in the County of Erie, in the State of New York, am the mother of John Doe, and being duly sworn, deposes and says the following:

 

The template is one used when the affidavit is being notarized.  I don't think the ones submitted to USCIS are required to be notarized (ie. it can simply be a letter they write, date, and sign) but having it notarized shows USCIS that someone holding a public office verified the identity of the individual signing.  Having it notarized does NOT mean the statements made within it are true.

 

This is not meant to constitute legal advice in any way, shape, or form.  Just something to assist with someone who may not have a strong enough prima facie submission.

I took the tack of including an affidavit to contextualize some of my other evidence.  In my case, my mom wrote a letter indicating that we had travelled with my parents to Europe, and that they had visited us in our shared residence, spent holidays together, etc.  I thought this would nicely square our plane travel receipt for the trips and some photos of us together.  

 

We also had pretty good joint financial information, so these are definitely secondary.  My only reason for including them at all is that we don't have a joint lease.   The Canadian consulate in Montreal is very strict on the petitioner's domicile, so I had already moved to the US and signed a lease for our apartment before his interview.

Jan 23, 2017: Interview...Approved!

March 3, 2020: Approved by CSC

Feb 2, 2020: File N-400 online

Feb 25, 2020: Biometrics
