AoS I haven't applied for SSN and my I-94 expires in 10 days

Hello,

 

after moving here in US we've been somewhat overwhelmed with the process. Now that we're finally ready to file for AoS, I realized I haven't applied for SSN, we are legally now married though. I have read in other guides that it's completely okay to apply for SSN later, after receiving your EAD. Just wanting to make sure that this is the correct thing to do for me now.

 

I have additional questions for filling in the paperwork, but I'll save them for another thread.

I came here on a K1 fiancé visa in October 2018, applied for my SSN 2 weeks after my arrival, my application was sent for manual verification... it has now been 10 weeks, numerous calls to my local SS office for an update but they are about as useful as a chocolate teapot.

My manual verification came back on the 26th November 2018 & sent back to SSA - Maryland (HQ im told) yet my local SS office state the process is still 'in progress'

My own I-94 expires tomorrow (10th Jan 2019) so i am officially giving up with SSN until i get my EAD card.

 

Long story short, there seems to have been alot of us who have had no joy obtaining a SSN as of recent & its been a frustrating time... but go ahead & apply for one before you I-94 expires or tick on your EAD application (which you can apply for as well as your AOS & AP) that you would like a SSN issued to you if you wish to not apply for an SSN yourself before then.

Your window to apply for an SSN is now closed until you file AOS with EAD and receive that EAD. Unfortunately you have waited until too late. Had you applied much earlier, you would likely have been successful. For now just focus on filing your paperwork, and you can apply once your EAD is in hand.. but you'll be waiting a long while for the EAD to arrive.

The OP's application window for obtaining an SSN has elapsed. I would also not recommend ticking any box like that on his AOS application. The OP will simply have to wait.

The EAD form has a section to ask for SSN to be issued if they don't already have one

Im not arguing with you, i was just making the OP aware they can apply for one when they file EAD, just trying to be helpful as im at the same stage as them

No worries, but I'm simply trying to clarify that the OP isn't eligible do that at all as a K1 on that form for an EAD. Ticking that box won't do them one bit of good as it is not an option that is available for them to use.

What about ticking it when you already have a SSN? Won’t that authorize them to give you a replacement card with your new name after marriage? That’s what I understood from the instructions and I was planning on filing my form like that.

Thank you for all the responses, glad to see I'm not the only one with these questions. I was going to ask about filling in these boxes in the application. Does anyone know the correct approach here? Answer "no" and apply for SSN after EAD has been approved? Since one person said it doesn't apply for K1 visa.

I would also be curious if there is an example on how to fill out the I-765 form for people who are now married with the K-1 visa? I'm not sure what to fill in on this part.

At this point you are out of the time-frame to apply for a SSN. And people needs to know that NOT all SSA offices are well documented or prepared. In my case on our local SSA office I was told I need to apply for Residence (AoS) first/get the EAD (They probably thought I was asking for a SSN for work lol), It wasn't worth objecting and I just leave it at that. I'll just wait until the EAD to apply. There is no big deal either way on having it now or later.

 

@M&Ma - Reading the official USCIS instructions also help. You have to put: (c) (9)

C9 Adjustment of Status Applicant (whether you're adjusting from K1 or any other visa makes no difference).
