going for CR1 is not the problem at list before going for cr1 the USCIS should give me the final decision at list read my reply from the Embassy.. My fiance can't just apply for cr1 without hearing the final outcome from the uscis.. The embassy said is not in their jurisdiction anylonger that I can mail the uscis for update and my case status keeps updating

The K-1 case has been returned to USCIS to close the case.

If you want to move forward, then marriage and the CR-1 visa is your only option.  If you can't prove a bona fide marriage, then the results will be the same as the K-1.

Sadly you or the petitioner will probably never find out the exact reason why.  Like others have said the spousal visa is really the only solution left.  You will need to marry, spend adequate time together and commingle your assets for the petition to have a chance.   If you are denied on the spousal visa it can be appealed whereas the K1 can not be appealed.

I am not judging you.  I never accused you of anything.  Don't attack me because you don't like my answers.

I told you what the US Embassy thinks and what they consider.

You don't think your prior attempts to get US visas are important.  Those visa attempts are important to the US Embassy in judging you for a visa.  They can consider everything about you and your prior attempts.

It seems that the US Embassy believes you have a pattern of marrying older US women to immigrate to the US.

The US Embassy focus on your credibility.  Your contention that they should focus on your present relationship and not focus on a dead person is wrong.  They are not focusing on a dead person.  They are focus on you and your credibility.  Everything is fair game.  Everything.

Your fiancee should consider moving to your country to be with you.

Please tell me how I judged you?  Did I accuse you of anything?

You have a decision to make now. Noting will happen to your petition but expire. So what you and your fiancee' need to do is marry and she can then file a I-130 petition. It will take 12 to 15 months.

I was just reading on your AP and your review. I think alot of your denial had to do with your were married to a US citizen before (sorry to hear of her passing) and then you met another US citizen and you got engaged. They may look at you as visa shopping.

Petitions that are returned take about 15 to 18 months to get a review back to petitioner.

Like I said get married file a I-130. Or waste time and wait the next year out. You could be married filed and done before you ever hear from USCIS.
