you mean, divorced because you and the sister connected before it was time...man, hate to break it to you but the chances of you bringing the sister of the exwife you petitioned before with a K1 and married has zero chance. Major red flags , sure you can petition if you like to throw money away.

Now if you were married 10 years to the first wife then maybe a chance...but if its a marriage of like less than 2 years then forget about it, wont happen.

forgot to add this , if you were the sponsor for the exwife mentioned on the affidavit of support and its been less than 10 years since she got the k1, then you have to list that and even if you don't they will find out and count that as dependent against the income requirements. Not even sure you can have two people to sponsor...unless the ex left the states gave up her status...

There's more rules to it than that. From the I-864:

"When Will These Obligations End?

Your obligations under a Form I-864 that you signed will end if the person who becomes a lawful permanent resident based on that affidavit:

A. Becomes a U.S. citizen;

B. Has worked, or can receive credit for, 40 quarters of coverage under the Social Security Act;

C. No longer has lawful permanent resident status and has departed the United States;

D. Is subject to removal, but applies for and obtains, in removal proceedings, a new grant of adjustment of status, based on a new affidavit of support, if one is required; or

E. Dies"

 

Note the 40 quarters of coverage is not the same as 10 years. It could be in fewer than 10 years if one can claim another's credits. It can be until death (of either the sponsor or the beneficiary) if one doesn't work and can't claim anybody else's.

 

You can sponsor as many people as you can afford.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Unusual situation but not entirely unique.

 

I used to have a friend when I was in the military.

His wife was previously married and her ex husband then married her sister so her children were being raised by their aunt/stepmother.

My friends marriage broke down and he subsequently started a relationship with another sister of his ex wife.

That sister had previously had a physical relationship with a man who at various times had been intimate with all three sisters (not at the same time! They're not weirdos!)

 

So while it definitely is a strange situation it's not entirely unbelievable but it will attract a lot of extra scrutiny 

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Sorry to intervene on a :pop:-worthy post but this was interesting tidbit - can you explain this more?   Under what conditions can you claim someone else's credits???

I dunno the whole thing sounds like they're all weirdos.  While I think my BIL is a great person, I would never enter into a relationship with him even if my sister and I weren't happy being sisters.  That's just weird...

My husband is from Alabama and I find this funny... LOL  obviously he had to search outside the country to find a non-sibling/cousin :D

It can occur with dependents or spouses. The conditions are limited, though.

Woman-focused, but most (all? I didn't read the entire publication) of it applies to either gender: https://www.ssa.gov/pubs/EN-05-10127.pdf

 

For example, a housewife that was married to somebody who earned 40 work credits can still meet this requirement despite not having actually been employed herself.

It has also occurred with a child. One case in the past year here on VJ was a child who did this and therefore qualified for an I-864W (a form for an I-864 requirement exception) when they were being petitioned for a green card.

So my husband, who was essentially a househusband for an extended period of time, *may* be able to claim credits as my spouse. Interesting.  I need to research more.  I knew about his survivor benefits in our retirement years, but didn't know about this possibility.  Thanks geowrian.  Always a fountain of useful information and links :)
