RFE ... did they stop those?

Hi everyone, is it true or has anyone experienced this. I've heard they stopped doing RFE. So if you are missing items or they need more documents they are canceling it and you'd have

to start again and pay that fee.... but I'm not sure. Anyone know about that or experienced that?

Where did you read that? If this isnt posted on the uscis website it probably isn't true.

I didn't read it anywhere, actually an attorney informed me of that.

IF you receive an RFE they will most likely sent your whole application back so you can update it to the point that the officer will be satisfied with your bona fide marriage. I do not believe you will have to pay the fee again. IF your attorney is requesting payment again i would check with USCIS yourself before issuing another check. That does not seem correct at all.

The attorney is either incompetent or a liar (because any competent one knows better). He/she is likely trying to scare people to ensure they stick with him/her.

 

There was a policy change this year in which USICS IOs are permitted to apply a lower bar for an outright denial instead of sending an RFE. Previously, the guidance was having "no chance" of qualifying for the benefit being sought to issue an outright denial. This changed to allow IOs to deny applications with missing required documentation in an attempt to curb "placeholder" applications. Placeholder applications were defined to be applications submitted lacking basic documentation in an attempt to get into the processing queue sooner with the expectation of submitting the documentation later (e.g. sending an I-130 before having the marriage certificate or all past divorce papers yet).

If i were you, I would go back to that Attorney and ask him/her to show the proof about the claim they made about RFE. If they can't show a proof (official proof), then you can ask them more question and grill their lying #######. No matter what I would fire their #######. 

 

there are numerous times, those immigration lawyers have no clue about what they are talking as it's their business but we here at VJ it's our life. We were a victim of lawyers stupid claim and we almost ruined our second interview. I just took a stand against what lawyer told my wife (USC) because I read so much in VJ and I knew those lying lawyers were wrong. That stand I took, was the one which saved a lot of time for us and we didn't screw up our second interview.

This isn't true at all unless they've changed something crazy in the last 2 months. In September I received an RFE requesting a marriage certificate for my I-130, something I had already given them with my application. It doesn't seem like giving RFEs is something they are no longer doing.
