Not the norm, but also not very rare for a separated couple to live under the same roof, at least temporarily.

You can't send what doesn't exist.

However you MUST respond to the RFE, even if you don't have/can't provide the documents they want.

I once dated a woman who's ex lived in the basement. That was a little weird, especially since he answered the door on our first date. 😮 She claimed he wanted to live near his kids, but that seemed a little too close.

You just didnt send enough proof. I got the same RFE. As the OP stated just send more evidence from the ones listed on the letter.

 

Did you guys have  join bank accounts ( send copies of bank statements from the period you file  until now.. Even is those accounts are now closed, you can still go to your bank and request those bank statement)

My mistake was, that I did not send enough evidence to begin with. When I got my RFE, I sent  all docs I could possibly send,

Mortgage deed

Home insurance policy

Bank Statements 2015-2018

Credit Card Statements showing each other as auth users

401k Showing him as Beneficiary

Life insurance policy

Birth Cert for our son

School records showing him as the guardian for my two daugthers

Medical records showing him as the emergency contact all three children

Medical Insurance policy and cards

AAA membership renewal letter showing both of our names

And two affidavits. 

 

I even sent an email conversations I had, one with my attorney, family member and my old landlord.

Photos are secondary evidence. You will need more than photos.


They want paper proof, like bank account statements, insurance, vacation receipts, letters from family or friends attesting to your prior relationship. Photos are on the low end of what they consider.

Do you have access to ANYTHING from when you were on the same financial stuff together?

If so, Send that, file the divorce waiver, and send anything else you can to prove that your marriage was bonafide. You can write a statement saying you don't have X, Y or Z and that this is all you could get due to the marriage failing.

Photos only capture a moment and time of your relationship, you will need more than that, And it’s normally used as secondary evidence.

If you are really concidering divorce, you really should send the additional evidence with the divorce waiver. I believe being transparent it’s always better.

1.  Photos show that you two know each other, not that you had a bonafide marriage.

2.  The RFE is not asking for photos---it provided a very specific list of evidence they will consider.  Send what (you have) they are asking for.

Thanks for the help everyone, there's not much stuff i can send to be honest besides tax returns, state id, utility bills, and some bank statements from when we had the account until we closed it and a will

i need help, how do i file the divorce waiver? is there a specific document for it or anything like that i can attach when i send the RFE?
