Presumably, with a denied I-485 the I-864 would be dead also.

 

But to answer you question, continue contacting USCIS. Escalate to a manager if need be. Or schedule an infopass (this is where you would got to a local office in person).

Normal response time from USCIS to withdrawal letters is roughly 2 weeks from what I've seen reported.  You can always confirm the withdrawal was received (again, if the i-485 was denied right after, that's a pretty good indication) at an Infopass.

I withdrew the I-864?  in  2017 but never get anything in the mail? So that's why I'm wonder if it was withdrawn? Because interview was around same time frame. Well no one seems to have the answer but thanks for all responses. I'll just keep sending in more letters to USCIS to find out if the I-864 was withdrawn. Thanks.

  Do you know the case number ?   what does it say online.  What state are you in .  The divorce laws are by each state. For example  California tend to only give spousal support for 1/2 the length of the marriage and there are calculators to how much each party should get. 

This will not be over quickly. You will not enjoy this.

A couple of us have suggested going to an Infopass appointment in-person as a solution to find out.  Unfortunately, no one here would be able to tell you for certain whether it was withdrawn or not (again, presumably it WAS withdrawn since the i-485 was denied soon after), only an IO can confirm it for you in writing.

You mention a VAWA case.

 

So where does the I864 come into this as you said she was unable to adjust through marriage to you.

Also as others have stated you mention her asking for spousal support and child support. IF you have NO children together why is child support even being mentioned?? Do you have a divorce attny? 

Yes have attorney her big issues are the forms I-864 and I-134 the problem with divorce and immigration attorneys no one has a clear cut decision on the financial obligation of each form. one say I-134 is useless other says its good for a certain time. The I-864 is another story.

The I-864 and I-134 have been mentioned in court at least 5 times each. So yes grave concern. This has been by her immigration attorney.

Sounds like you need a Lawyer that knows what they are doing.

 

I 134 is unenforceable and only related to the K1 and she never adjusted status so the I 864 is not in force . Could go on about the I 864 but not relevant.

The judge will be looking at this claim during the final judgment of support this has been his determination. Also will look at the I-134. She is looking for spousal and child support for her son who is 13.

Denied I-485 = dead I-864...she can not adjust through you......immigration case closed as far as you are concerned........But divorce is a whole different animal which has zero to do with any I-864.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
