Hi all,

My fiance arrived in the US a month ago. After much discussions, we are thinking for him to go back to his home country before his K1 visa expires and get married there then apply for a CR1 visa instead. My question is, if we go to this route, what are the chances that our CR1 visa gets approved knowing that we did a K1 visa and did not push through with it? Hoping for your kind and honest thoughts

Why bother going through the expense of the K-1 if you want to marry in the home country?

An immigration visa is not a chance based process.  It's about your relationship.  As long as you got evidence of a bona fide relationship, then that's all that matters.

It will take about a year for you to file a CR-1 for him.  He can not come back on the K-1 visa.

Not to be judgmental, but, what happened in the last month to make fiancé need to go home to both sets of parents?  Didn’t you two think of that before he came here and you wasted all that time and money on a K-1?  This absolutely baffles me.

You can certainly cancel your K-1 and apply for a CR-1. I successfully did this, albeit I have been in the same country as my husband for a number of years.

Just make sure you write to them confirming cancellation of your K-1 so there is no confusion on their end :)

Can’t cancel the K1as it’s already been used. You just don’t go through with the AOS and leave the US.. married or not .. in under the 90 day stay

If he is going to leave, make sure he goes before the I-94 expires.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

@Cazl16

Would you and your fiance be willing to have a small ceremony in the US to complete the process, then go back to your fiance's home country to have a full fledged wedding ceremony? Many people who have done the K1 have done this option.

It just seems that you are so far in the process, you might as well benefit from it.

I wasnt supposed to go through this blog but I dont know why I ended up in this, may be curious... unless there is a reason for one person who dont like this relationship I wouldnt suggest to go this route. The timelines and getting approved again bcoz of this K1 not utilizing is clear indication that u two never wanted to be together, so they could deny or delay ur visa next time. I guess you should follow what other VJers are saying. If something personal reason then I wouldnt dwell more into this..
