I have, but this is usually because they don't know the age restriction of the CR1. One must always ask if kids are involved and the ages. I would never have picked a CR1 and have never regretted the K1.

Two things to consider OP, as you think through this.  1. Length of time and documentation required to get married in the UK.  It may not be possible in January if there is a visa required for a UK marriage, paperwork, etc.  You may want to look at another country where marriage is faster/less documentation or waiting, some have chosen Iceland as a good place near the UK to get married, or if you can visit the US to get married, Las Vegas.  2.  How many times have you met in person?  For a CR1, you will need to submit evidence of an "ongoing marital relationship," and documents showing this will be important to send with the I-130 petition.  The more visits, time spent together, the more likely visa approval.  Don't rush the filing of the I-130 without evidence of your time spent together and co-mingling of finances, even living apart in two different countries, there are lots of ideas on this site for you to consider about how to do this.

But I'm sure they have proof of their relationship prior to meeting.  I think commingling of assets would be harder if not thought out before.

Thankyou for all of the help shown. We've been together for 18months now, and yes evidence of our relationship is not a problem. We've decided the correct path we need to take that suits us. Thankyou all for you're advice it's been most helpful.

Unless he has an EU passport as well as his US one he will need a marriage visa to marry in the UK. Unlikely you have time to get one now for a January wedding, given that the embassy will be closed a lot in the coming weeks for the holidays. Unless you are planning for the end of January.
