Adjustment of Status affidavit threats

Hi everybody! Me and my husband send my AOS package in April and my husbands brother and sister in law were the people who wrote the affidavits since we lived with them for over a year and we were really close. They turned out to be really bad people and now they’re blackmailing us for paying their phone bill(they’re on our contract just added as lines). They refuse to pay their bill and say that if we sue them they’re going to retract their affidavits and say that they lied about everything they said initially (which is not true, everything in their affidavits was completely real.) My question is could that really affect my application?

Take their phone numbers off your bill! 

Yes they’re saying if we do take action they will say they lied in their affidavits. They also put us in debt which is unrelated to the phones and they won’t pay us that money either because if we take them to small claims court they’ll try to do the same thing.

I think it sounds like it’s time to get them out of your lives they do not good. 

 

Dont be worried about the immigration part of it.

im not the suing type. pay the bill and remove them from your life. hopefully you already cancelled the lines. this is why you dont add people onto your accounts. or loan money you can't afford to never see again.

I spoke to our lawyer about it and she said its not in our best interest and pretty much told us that immigration will listen to what they have to say about their affidavits which will affect us. However I don’t think its legal for them to retract true statements just so they can lie.

Begs the question if you have a case that will stand up in court, do you have a written agreement?

Isn't there a statement on the affidavits saying that "everything is true to the best of your knowledge under penalty of perjury" or something like that?

Or is this not the I-864?

Not that I suppose it makes a difference at this point, it doesn't sound like they are very supportive regardless.

Not that I suppose it makes a difference at this point, it doesn't sound like they are very supportive regardless.

Its the affidavits for the aos proving that we’re in a real relationship not the sponsorship ones. They are sworn and signed too.

Is it AOS (I-485) or ROC (I-751)?

I don't recall we need to submit affidavit from friend and family for AOS, but it may be needed for ROC if you don't have enough evidence to proof your marriage is legitimate.

Did they include the wording “I swear, under penalty of perjury, that the foregoing is true and correct to the best of my knowledge.” in that affidavit? If they did...then it's them who will face federal crime. 

in the meantime, if you have other friends and families that know things about your marriage, maybe ask them to write the affidavit, just in case you needed during the interview

Its for I-485 it had to be sent along with our photos proving that our marriage is real.
