Has anyone here dealt with a Delayed EAD/AP?

Hi, 

My wife has not received her work or travel permits yet. We applied for AOS, EAD, and AP in April. Completed Biometrics in May, and in September started receiving biweekly emails from USCIS stating our case is ready to be scheduled for an interview.  We also had a congressional inquiry and on Dec 6. Has anyone here ever experienced anything like this?

 

I received the following response regarding the congressional inquiry: 

 

Form: I-765 / I-131

 

Thank you for your inquiry regarding this constituent’s immigration matter.  U.S. Citizenship and Immigration Services (USCIS) records confirm that your constituent’s cases are pending at this time.  USCIS is committed to adjudicating immigration benefits in a timely and efficient manner while also complying with all relevant directives.  While the processing steps for most applications or petitions are completed quickly, a small percentage of cases involve unresolved issues that may result in adjudication delays. 

 

We are unable to determine at this time when the review process for these cases will be completed.  USCIS will issue a decision on your constituent's cases as soon as possible.  

 

We hope the information provided is helpful.  If we may be of assistance in the future, please let us know.

4-6 months seems the norm and yours is a bit longer than that, the reply is generic, nothing specific to your case.

Nobody can answer that question, we can see norms but there are outliers.

Right. Still would like to hear from people who had similar delays and what their outcomes were.

-Staff took vacation

-Holiday...

-If you have an emergency situation, you can go direct to USCIS field office to request an emergency AP. If not, there is nothing to worry .

We applied for AOS/EAD/AP in April and received the EAD/AP in early September. 

A couple I'm friends with applied 3 weeks after us in May and still has not heard anything. Because they fell outside of processing time, I recommended they contact the congressperson. Yesterday, she told me the congressperson got back to them and apparently the USCIS misplaced a paper somehow. They claim they sent my friends an RFE in July but my friends never received it. Now there is an investigation and the congressperson is supposed to continue helping them. 

I don't know if this information is helpful, but you asked for similar stories so that's what I am writing about. The congressman's letter sounds very generic.

Maybe schedule an InfoPass appointment? Have you spoken to a Tier 2 officer on the phone?

We sent our AOS package in April. I just received my EAD last week, no updates on their website however. It still says fingerprint review completed. The status of non of my applications changed, have not received interview letter yet either

Hi, thanks for the info. It's nice to hear you have your EAD already. Hopefully, your friend will get theirs soon. We actually did contact USCIS a couple times but we didn't know there were "tiers". We just followed the prompts and asked the agent to make an inquiry for us. They said we could call back every 30 days. We also would check Infopass daily until just recently when they stopped accepting appointments in Chicago. We even scheduled an Infopass appointment in Indiana but canceled it when we found out they only accept applicants in their area. How can we get a hold of a tier 2 agent?

Congrats! Yeah, I've read of other people getting their work and travel permits without seeing an update online. Did you create an account or do you just check the status website?

When you call the USCIS, ask to speak to a Tier 2 agent. They will connect you.

Great thank you. We just called and asked for a tier 2 agent. They said they would call us back in an hour. I'll post an update once we hear from them.

Ok, so here are our latest developments. Today we called the USCIS for the 3rd time (800-375-5283) and these were the steps we took.

 

1) When we called the options we selected were to dial "1" for English, then "1" for Case Status, then "1" to enter our receipt number, and finally "3" to speak to an agent. We were on hold for about 15 mins (expect to wait anywhere between 15-30 mins)

 

2) Once we got an agent we explained that we made a "service request" (inquiry regarding our case) twice and a "Congressional Inquiry" within the last 2 months but haven't received a response yet and that we'd like to speak with a "Tier 2" agent. We were put on hold again for about 5 mins, then transferred to a recording that said they would call us back. (They asked for the best phone number to reach us at)

 

3) About 30 mins later we received a call from a Tier 2 agent and we once again explained our situation. We specifically asked if it was possible to have our EAD case "expedited" and they said yes, and that we should get a response by next week. The agent also said that he thought we would most likely get the approval and my wife's EAD card mailed to us at the time of their response.

 

I hope this info can help someone else.
