I have a related question. On the Adjustment of Status and other forms, will we have to fill out Yes to Has the person ever been denied a visa? Even if it's eventually approved and this is just a soft denial because there's no pending ?

 

My guess  is going to be yes, and all of the headaches associated.

Thanks, I'll really try. Again, thank you all for the help, you've calmed me down, especially with the if they keep your passport that's good talk.

I'll try to stop worrying, but I know Christmas is coming and those 'business days' are going to start piling up and I very well may not hear back in a little while. We don't have any immediate plans, but I do have a wedding venue for a ceremony in 2020.

I don't think I'll have to worry about any plans getting mucked up if this is just a pause though.

I want to thank u for this thread. I explained the situation to my sweetie including the legal rules about close-of-business issue/refuse. She was denied a tourist visa twice (due to income) and i feel like the discussion about this practice will only help her composure when the interview day comes.

Tourist visas are a completely different animal, and have no impact whatsoever on fiance or spousal visa procedures.

Agree completely. But the person is the same sweet Filipina going to the same Consulate in a 3rd party country where her enthusiasm was crushed twice before.

I understand.......The vast majority of tourist visas are denied due to insufficient ties to the home country.   For fiance and spousal visas, a completely different standard is used.........good luck.

Income? Income is not a requirement for a tourist visa.

 

Having a stable job to return to - and ot likely to work in the US - is beneficial is sowing intent to return home. But any particular income level -or none at all - isn't required for a tourist visa.

Being denied a tourist visa from the Philippines is very common.  With OFWs being the #1 export proving that there is enough to come back to is tough.  I had a friend with a good job, a side job (store) a home she owned and a 10 year old son.  They said she didn't have enough proof of a possible return to the Philippines.  It is at the sole discretion of the CO and my guess is less than 50% actually get approved.  

 

Those denials of the tourist visa application will have no impact on the fiancee/spousal visa petition.  It is important to see the difference between "application" and "petition".  They are VERY different.  The interesting question is "Have you petitioned anyone before".  Technically a tourist visa is not a petition.  Either way I think either answer can work.

In October they approved almost 10000 tourist visas.  I can only imagine how many applications there really were

So everyone gets approved then goes into AP, or everyone gets the Refusal paper with the AP? or some combo of both?
