That's evidence of infidelity which you said you knew of before you brought her here.

As stated previously, infidelity does not equal fraud.

I didn't see anything that stated she used you to gain immigration benefits...sorry.

That might be divorce evidence, but it is not immigration fraud evidence.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You would have to prove that she married you for the purpose of immigration. Like hard actual proof, like an e-mail of her saying "I married this USC to come to the US. I plan on leaving him the second I touch land!" and then PLENTY of more proof of it. You saying "SHE WAS TALKING TO ANOTHER GUY" just comes across as an angry ex than someone worried about US security.

It's very possible she loved you when she married you and just happened to have strayed shortly later. It happens to regular couples all over the world, with or without immigration involved.

What country is she from??the other man was american too?  Its kinda odd if ur marriage was 100% that she would have a need to do this, and together with having little baby by her. And odd for the other man to be ok w it. But whatever ur issue in marriage was, it is not fraud. u cant do much anymore than continue to be a good dad.

hmm its clearly infidelity  at least thats confirmed , but mistake was continuigng the process knowing , did you do an interview together? b/c that would mean you also did fraud

Yes, any father would commit immigration fraud.

 

Yes, any father would get his son's mother deported making it impossible for them to have a relationship.


For the sake of your son, move on and learn to co-parent.  


How is deporting his mother going to help him?  How is growing up to know that you don't have a relationship with your mother because your father had her deported?

 

Bottom line.  You got nothing.  Go ahead and spin your wheels.  Instead of trying to find a way that works for your son, you should go for revenge and f the consequences to him.

 

Any father under your circumstances would work on getting your son's mother deported.  And you're nothing even acting under duress at this point.  This is all on you.

Why would he have letters SHE wrote her lover three years ago? They look immaculate and the letter to her is still inside of a legal pad. None have been folded, none show wear and tear and again... still inside a legal pad...

I discovered the letters in her Facebook messenger. Each of them wrote a letter, took a photo, and sent them on Facebook messenger. I only discovered these the following May 2016. I found these letters and numerous photos, text messages, and emails.  The fact that these are hand written, signed, and dated is why I feel they’re important. I have other unsigned notes. The fact that her visa had not been granted until June 2016 means she knew the marriage was fraudulent on 31 July 2015.
