Not official but I'm sure you can find an official source. 

 

 29 CFR 2590.701-6  is the official source. I don't see anything about immigration listed. The qualifying events that may be used would be marriage or loss of other health coverage.

Does your husband currently have health care coverage - will he lose it by leaving his country?  If so, go back to HR and ask them what happens if your husband loses his coverage.

This! I was wondering how this falls because they are already married so that is not the event, but yes, by him coming here he might lose his coverage, and that definitely makes him qualified (this is how I got mine, I quit and lost my coverage so I was added to my husband's outside of open enrollment because that is a qualifying event-However, we had to pay for my premium). Like I said previously, your employer DOES NOT HAVE TO PAY for his premium though. I think maybe whoever you spoke to just isn't aware of how it works with immigration like others said.

Thanks everyone. I asked the HR person if she can look into it, because I believe she is wrong. She just e-mailed me earlier today and told me that she, in fact, was wrong.

Like someone stated earlier on this post, she was just unfamiliar with immigration.
