OP has a rather good shot at getting a tourist visa if he can provide compelling reasons to leave the US after visiting.

 

There is no niece/nephew visa.... they cannot file for his children.

Destroy your records?  Ha. Ha.  How is he going to destroy records in the US Government's databases?  

 

What are the siblings going to file for?  What visa?  An uncle or aunt can not file ANY THING for a niece or nephew.  So, how is it the "best thing" for his siblings to file for his kids?  What do you suggest they file for?

 

How does your advice help him get a visa?  

 

Your advice is so bad.

Nope that wouldn't be the best option in your case, your case has becoming a complicated one now. My advice from my experience is to get or hire a good immigration attorney and explain everything to him/her. Maybe he/she might first try to apply for a waiver on your behalf, because your first K1 as at now is still in their database until you redraw or file the waiver before applying for any other Visa or benefits. I stand to be corrected if am wrong here. I have a very good attorney who helped me overcome my CR1 NOIR case, you can contact me if you will need help. Thanks

No attorney is needed for a tourist visa application. They can do nothing with the decision.

No waiver appears to be needed here. Even if one were needed due to some other reason, it is recommended for by the CO (or not). It's not something you can apply for (which differs from K-1 and immigrant visa cases where you can apply for certain waivers on your own).
