FORM I-485 AOS RETURNED

Hi all,

 

I am from England, and my wife is American. I arrived in New York on a K1 visa, on the 26th October, and had our wedding on the 4th November. We had no issues with anything visa related when filing the first step of the K1, other than getting a bit worried about the timing being to close to our wedding! However, since we got married and send the AOS and all the supporting documents on the 14th November, USCIS have since returned the package, which we received 2 weeks later on the 28th November. 

 

The reason that they said it was returned, is that we paid the wrong dollar amount. Now, I am a 27 year old male. On the government website, the fee clearly states $1,225, which is the amount we sent - https://www.uscis.gov/i-485

 

Me and my partner both find this very strange, and we’re not sure where to go from here, as we have so far found it impossible to get hold of anyone by phone when dialling the number provided. We tried emailing the next day and are yet to hear back. We are kind of in a rush here as I’d like to start working ASAP and then obviously there’s the 90 days to file.

 

A couple of other questions I have, is that when the package was sent back, the doctors form which is to strictly only to be opened by a USCIS officer, was sent back opened. Do I just send it back as it was sent back to me? 

Lastly, they also stated that some of the forms that we used were out of date - however we printed them directly off of the government website before printing them, so this seems strange. 

 

Sorry for such a long post, but I would be extremely grateful for any help that anyone can offer.

I'm not sure how correct this info is but I think you also have to file form i130 together with i485 which is an extra $585. Experienced folks correct me if I'm wrong...

 

As for the medical, I would attach a letter stating it was sent sealed and resent open

 

As for the forms, check the edition. It should state if it's the latest edition on each form

No I130 required for aos from k1

Yeah that is strange coz I sent my aos nov 6 with that exact amount. I did 130 also which is 585.My husband wrote two checks one for 585 and one for 1,225. So not sure why they sent it back to you.

aos from k1 dont require 130

are you a k1? they didnt sent back your application?

 

his case is strange.

 

if 1225 is not the right amount why we didnt get rfe for that.

Hello,

I'm also in NYC and I sent my AOS from a K1 to Chicago in early August with a check for $1225. and it was accepted without any problem.

Did you sign the check? was it written out correctly? That is the right amount.  I just sent ours for that amount (haven't gotten NOA yet though) It was just signed for on Dec 3rd.

Maybe list here what documents you sent. 

Not an expert but there may be a document that may have been included by error and it requires fee since it’s included.

 

I think listing your documents may help locate where the error lies. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Hi

I had similar issue when I applied for AOS few years ago and they returned by application. It was tough to know the reason they returned it. Did you apply for employment authorization?

In my case I had put a wrong eligibility category on the I-765 form. EAD is free if you apply with AOS and that is eligibility category C 9.

If you pick any other code , you have to submit payment for it  and if they do not find the payment, they might return your application.
