She has to serve you with papers if she has filed for divorce. The papers are either notice that divorce has been filed, you can be given an option to waive your rights (I wouldn't) or a combo of both. But she can't just file for divorce without you knowing about it, at some point you're going to either be called into court or be given something to sign. If you are truly curious you can go to your local courthouse or where ever the divorce would exist in your city and see if there's anything there.

I wouldn't wait to hope you get approved without interview, not everyone just gets approved without interview.

Separated doesn't matter as long as you are legally married. As long as you're married, she can either go there to the interview with you and ya'll can explain that you are separated as people have done it before and hope that she doesn't say anything to sabotage you, or she can simply not go and you will be denied ROC because she has to come to the interview. If you don't want her having anything to do with your ROC, then you need to get the divorce done.

Do not wait for her, she's trying to get money out of you. You need to take the first step to protect yourself.

thank you sir for this informations!

If you were living in a car with no address she probably filed via publication..  Although she apparently had your phone ID and could find you , she is probably hoping for an uncontested divorce due to you not responding. Find the local court  and look for a filing , you can sometimes do this online.

no, i am living in an apartment now and have an ok job thanks to god!

we still have a joint bank account and I guess she can see how much money I have ( not that much) and I guess that's why suddenly she is asking me for money!

No you can proceed with the divorce waiver as soon as you start your divorce, you do not need it to be finalized first.

that's very good to know!

so I can start the divorce process and then file for divorce waiver!

Well technically according to the I864 Affidavit of support she should be supporting you, no?  She is responsible for you until you become a citizen (or leave or die or work 40 quarters)

That's correct, I did read that online from a lawyer online.

You are working and can work and for a single male difficult to see how the I 864 could be leveraged.

Sorry you are experiencing this..

I agree with Ontarkie and  Ash.1101    - you don't have to give her any money, you should  file for divorce and move on - with your life and I-751 with a Divorce waiver.

Have you filed the change of the address with USCIS, online Form AR-11?...  Hope you got your biometric done before you got thrown out of house and no USCIS notifications were missing  while you lived in the car...

I didn't change my address yet.

biometric is done and I already got green card extension for 1 year.

we filled for I 751 October of 2017. the case still stuck at case received at my local office.

Once you moved, you need to file AR -11, Alien's Change of Address.

https://www.uscis.gov/addresschange

https://www.uscis.gov/ar-11

Besides, you never know what's going on with your case - if RFE, for example, issued, USCIS will send it to the address they have on their record. Which is previous one. So, you may not be able to respond to RFE and it can lead to your I-751 denial.

Also, USCIS has recently started sending out 18 months Extension Letter.

We filed in June, 2017 . 1st, 12 months Ext.Letter arrived in July, 2017.  2nd,  "new" 18 months Ext.Letter - in August of 2018.

Yours, probably, is on it's way, sometime soon. Or  some Notice from USCIS, or an actual green card... To what address?

As you're the beneficiary, your wife has clearly forgot and neglected her legal obligations under the affidavit of support that she signed as your sponsor. Was you working at the time of being kicked out of the house?

Also don't pay her a dime. Retain all evidence because she's essentially trying to blackmail you and consult with a lawyer.

No obvious legal obligations here.

This is what I thought too! Couldn't that be counted as abuse what she is doing?

What could a single male claim anyway?
