I need help it's urgent!

Hello guys.

I am currently separated with my wife after we did apply to remove conditions on my green card. I am October filer.

We had a problem one day and iv been thrown to the street  as we were living at her parents house ( they have 2 houses)

I did struggled and lived in my car for a couple of months, and struggling with life, but never asked for government help or assistance,  i worked hard and i rented an appartment and i live a normal life now. She never asked about me if i am still alive or dead. 3 days ago she texted me asking for Money! Yeah she said she was providing for me before i started working and now i need to pay her back or she will take legal actions! I don't know what she want to do, but she is asking me to pay her about 4k. And she keep texting me to give her money or she will take legal actions.

Please guys let me know what to do pr any advises.

No we filed the I751 together, aftee few months we get into an argument and she asked me to leave the house. I am on my 1 year extension. And i am not sure if i can wait until i hear from uscis about my case as they are getting closer to october filers and i saw one approval today.

Oh ok, I am no expert but I am assuming that if you already filed to remove conditions and after the fact she kicked you out then you are ok, what can you do as it's not your fault. I would make sure first that the marriage is completely over, don't rush anything without being sure, if it is keep all texts and make an info pass appt at the USCIS in your city. Explain to them that you are already filed for adjustment and your wife kicked you out, this will stay on the record that you went there, you don't want them to question why you didn't go earlier.These are the types of scenarios that make Morocco so hard to get approvals from, why any woman would do this and hang legal issues and money over the guy's head is really mind blowing to me. Protect yourself, go to USCIS info pass once you're certain it's completely done and inquire. Best of luck to you.

Get a divorce lawyer and if you aren't divorced by your interview, then it's my understanding that your spouse is required to attend as you two are still legally married. You may have to push off an interview until you can proceed with a divorce waiver.

This is something that you will want to start ASAP.

But i can't proceed with waiver until divorce is finalized!  We are still married but separated at this moment. I am not sure she filled for the divorce yet. And i dont know if I need to wait and see if my case get approved soon.

She has to serve you with papers if she has filed for divorce. The papers are either notice that divorce has been filed, you can be given an option to waive your rights (I wouldn't) or a combo of both. But she can't just file for divorce without you knowing about it, at some point you're going to either be called into court or be given something to sign. If you are truly curious you can go to your local courthouse or where ever the divorce would exist in your city and see if there's anything there.

I wouldn't wait to hope you get approved without interview, not everyone just gets approved without interview.

Separated doesn't matter as long as you are legally married. As long as you're married, she can either go there to the interview with you and ya'll can explain that you are separated as people have done it before and hope that she doesn't say anything to sabotage you, or she can simply not go and you will be denied ROC because she has to come to the interview. If you don't want her having anything to do with your ROC, then you need to get the divorce done.


Do not wait for her, she's trying to get money out of you. You need to take the first step to protect yourself.

  If you were living in a car with no address she probably filed via publication..  Although she apparently had your phone ID and could find you , she is probably hoping for an uncontested divorce due to you not responding. Find the local court  and look for a filing , you can sometimes do this online.

This will not be over quickly. You will not enjoy this.

Well technically according to the I864 Affidavit of support she should be supporting you, no?  She is responsible for you until you become a citizen (or leave or die or work 40 quarters)

I agree with Ontarkie and  Ash.1101    - you don't have to give her any money, you should  file for divorce and move on - with your life and I-751 with a Divorce waiver.

 

 

Have you filed the change of the address with USCIS, online Form AR-11?...  Hope you got your biometric done before you got thrown out of house and no USCIS notifications were missing  while you lived in the car...

No you can proceed with the divorce waiver as soon as you start your divorce, you do not need it to be finalized first.
