hello,

I am here in need of some information, if somebody can help me please.  

Today, my stepson had his medical exam in El Salvador,  He admitted that he had tried marihuana three times.  The last time was the first week of october, he was referred  to see a psychiatrist.  My husband is hoping to get the appointment next week because the interview is schedule on Dec 10, 2018.   My question is, since he is a minor, what are the probabilities to get the visa approved on the interview?  It has been a long journey and now this situation.

as far as i know, its usually a year ban. sometimes thats not the case but pot is one of those things taken VERY seriously here and it is NOT legal at the federal level, which is the level you need to be concerned about

Being a minor will not keep him from a 1 yr ban. The ban tends to vary between countries. 

 

There was another member on here whose teenager admitted pot. A 1 yr ban was given. They can and often also do periodic drug testing. So that is something else they can do.

yes, we are concerned, we did not have an idea that he was doing this.  As  you mentioned even if it's legal in CA it's not legal at the federal level.    I'll provide an update on December 10.  I know even know what to expect at this time :(

Once is all they need to give a 1 yr ban. Why would he lie about using it, plus knowing he would be asked about this and than smokes it a month ago.

sorry sweetie, from one mom of a dumb teen to another. All I can say is I'm REAL glad my future isn't in the hands of my 20 year old. Bad enough HER future is 😕

You are right but what I was trying to say is that we don't know for sure if he has been using it more than three times but as you said only 1 time is needed to give the 1 yr ban.

Oh I know I've already been through the teen years 4 times already. What I meant was if he was going to lie about it he would lie saying he never used it at all. Unless he thought saying just 3 times vs 100 times would look better? They definitely  are not bright at that age.

I seen people get the 1 year ban, Ive seen a 3 month ban and I’ve seen people get no ban. Both the 3 month ban and no ban were from the UK. I’ve seen a lot of 1 year bans from Latin American countries and Caribbean countries unfortunately. Good on him though for being honest. If you do get the one year ban it will start 8 weeks after the decision (to allow for the drug to get out of his system). He should have been drug tested at the medical. If he comes up positive he will most definitely get the one year ban. If he comes up negative and gets a psych evaluation that says he’s not addicted to any substances and it was simply him being a stupid kid and trying it a few times you might see a better result. Ultimately it’s up to the CO and the doctors there.
