Important Question about Libyan K1 Visa in Regards to Trump Travel Ban

Hello,

 

I'm a Libyan applicant applying for a K1 visa (Got the NOA1 on 11-9-2018) and I've search all over the internet, called up the NVC, called up the US Embassy I'm going to be applying for, and I've *never* gotten a straight answer from anyone, it seems that no one really knows ??

The presidential proclamation (travel ban) the tldr version is: 7 countries are under certain entry restrictions;

In regards to my case, it says that: 

There are restrictions on Libyans entering the US
According to the Proclamation 9645:
No B-1, B-2, B-1/B-2 Visas and "No immigrant Visas or Diversity visas are issued"
 
The K-1 Visa is classified as a non-immigrant visa everywhere officially, but due to the current confusion and how it's practically speaking, an immigrant visa, do you think it will be suspended?

I started tracking visa statistics last year when my husband and I went through some difficult visa issues. 

 

Not commenting on the proclamation, I can tell you that this far in 2018, Libyan nationals have been issued 3 K1 visas, 5 CR1 (which is an immigrant visa) (58 B1/B2) and a handful of others. I can tell you the lowdown on categories/numbers if you are interested - send me a message if you are. 

 

What the USCIS doesn't release is the number of applicants/petitions. Its possible some have been sitting in Administrative Processing for a long time, but hopefully you have some solace knowing that IV and NIV are still making it through Libya.

I've been searching for an answer to this question too! I'm a dual national Iranian-British and have been wondering if the travel ban will affect K-1 visa for me. So far, there has been no indication that they won't give me a K-1 visa. My case has been taking longer than most people, I filed in March. Only recently we got RFE but that was for something irrelevant to my nationality. Fingers crossed, the travel ban won't apply to either of us.

Dual citizens (with a least one citizenship not on the ban) are not impacted by the EO. So you should be fine there.
