Does fiance visiting beneficiary affect affidavit of support?

Hi there. My fiance wants to visit me for a few months, about 2-3. He makes about $23,000/year. Now, if he gets absent from work for 2-3 months, the yearly tax returns will decrease, would this affect affidavit of support proof for AoS negatively?

K-1

More expensive than CR-1    
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)    
Spouse can not work until she/he receives EAD (approx 5-6 months)    
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
Spouse will not receive Green Card for many months after Adjustment of Status is filed.

 

CR-1    
Less expensive than K-1    
No Adjustment of Status  (I-485, I-131, I-765) required.    
Spouse can immediately travel outside the US    
Spouse is authorized to work immediately upon arrival.    
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US. 

My Final Analysis:  If you can marry your fiance outside the US, CR-1 is a much, much better option

I just think all couples should be aware of the differences and advantages/disadvantages of the K-1 and CR-1.  Many people don't realize the difficulties until it's too late.  Every week, we see people who have a great deal of difficulty after entering the US via a K-1 in the areas of Social Security numbers, driver's licenses, being able to travel outside the US and the inability to work for about 6 months......

Wouldn't the interviewer ask the beneficiary why he/she went for CR1 instead of K-1? And I'm sure "Because it's better" isn't a very good answer...

I guess the CO could ask that, but I'm not sure why.......but that answer is true for many couples.

To answer the original question yes it could have an impact if his income is under the threshold as it could require a co sponsor.

how can he afford to take that much time off work with that income? shoot, i make well over that, and paul makes more than me, and we each took a month off last summer and it killed both of us 😕

 

Anyways, yes, it can have a negative impact for the i134 or the i 864. At that income level, I would recommend a co sponsor anyways. Supporting 2 people on that will be difficult.

That is a reeeeeally low income for the US. He should focus on saving what little he can just to have some money when you arrive and you are unable to work (if coming on the K1). By taking off time and losing more money, he would likely fall below the poverty line which means he couldn't even sponsor you. As someone mentioned, you guys should probably get a co-sponsor anyway. Well above minimum wage. $11/hr provided the OP understands the difference between gross and net income. 

I make 27k a year gross but only 20kish net.  Death and taxes.... 

Hubs loses almost half his income to taxes and healthcare for both of us.
