Will child support affect our K1 visa process?

Support  is calculated according to formulas in the state specifying the order. It is not that easy to deviate from the standards - especially lower; rules about how to change the state with the order are complicated so do not expect that he can choose which states guidelines apply.  He can find the worksheets for most states online to see how his order matches the standards.  He can also not just go back for modification any time he wants to try to get his order changed especially if the order is recent.  He needs to view some of the family law forums for the discussions on support, custody, and visitation.

 

You state4 that you plan to have children. You need to realize that children you and he might have come after his current children for financial support. In most states, the fact he has children born after the support order will not affect that order. Any income you earn will not be included for the calculation of support but additional income of his may.  You should read family law forums for a view of your future; you should expect to become the primary wage earner since he has his already born children to support.

 

It sounds like both you and he need a reality check on your financial situation. His sponsorship income is the least of your worries.

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

ummmm he needs to take care of his CHILDREN before ANYTHING else. Child support is not optional and if hes not making enough, he needs to find a new job or get a second job.
