HELP!!!! Am Depressed

I really don’t know what to do any more, the waiting game is draining, my high hopes are now hopeless hope 😭😭😭 am going crazy.

Am the beneficiary from Nigeria while my fiancé the US citizen submitted the form 129f  6th of February 2018 and he got the NOA1 February 16th.

30 August  2018 he got RFE stating that He should submit more evidence such as , latter of intent to marry from the beneficiary, circumstances of meeting , Two years meeting requirements, which he mailed out 11th of September 2018, he waited for about a week or two get a response from Uscis to be sure if the RFE was received but to no avail . He called uscis and he was told that it’s not a requirement to response to RFE I.e they don’t send updates as to if they received  a mailed RFE  in most cases . ( well I don’t know if that’s true ) Its over 2months now and we don’t even know what’s going on, still waiting for the NOA2. 

He called uscis few weeks back and they told him to wait till 3rd week of November before they can take any action . It’s the 3rd week now and nothin yet .My Questions now is what exactly is going on ? Why all the wait??? I guess we are the only February filler left . It’s really Tiring and frustrating. Below Is the last mail he got .😭😭😭. I need help .

Please do yourself a couple of favors like installing a tracker app on your phone or creating your own account at the USCIS website not to rely on your fiance's updates. You will be fully informed just in one click. Please remember whatever you mail out to any state agency MUST go with signature upon delivery so that you will never guess as to whether or not it was delivered, where to, when, who received it etc. Just always do it like that. Do discuss with your fiance all things you are doing together and/or for the sake of yourselves being together. Do your own research if you like. Make sure you have everything in order before you take action. K1 visa journey is a tough way and you'll be better off as two able minded team members than a petitioner and a dependant beneficiary. Communication and informed actions are crucial.

Well it’s not funny . And like I said , he submitted all the required documents, guess they needed more evidences or maybe it was misplaced. Thanks

What did he originally submit in terms of proof of meeting and circumstances of meeting?

So you are from a high fraud country, didnt include half of the required information and are wondering why it hasn't been approved yet?

It should have been HEAVILY frontloaded.

 

was the rfe replied to with a signature delivery? Things get lost in the mail all the time. Signature delivery is a little bit more, but the only way to know if it was delivered.

 

i hope youve met more than once, too. The only K1s Ive seen approved from ghana are ones with MULTIPLE in person visits prior to filing and TONS of evidence that was submitted with the petition. Even CR1s are hard with only one or two visits.

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

Exactly!  These are the very things that will today result in an automatic denial without an RFE. They are lucky they even got one.

Well, OP commented above that her petitioner DID send that stuff in but perhaps it got misplaced. However usually if things get lost, it's only one item. Not sure how they could have managed to lose ALL the pertinent documents. Anyhoo.

Sorry but this is just how the process is. It is long, annoying, depressing and difficult to get through. You're not the only person and certainly not the first person to feel this way about it. Just to give you some perspective: according to the latest report, USCIS reported 30,353 pending I-129F petitions during this year's third quarter. Add on top of that the fact you have to do AoS after you get your K1 and marry. In the same report: 372,057 pending I-485's in the third quarter. On top of THAT, you will have to do RoC and then N400 (if you choose). The K1 is only the beginning. Get used to that.

I looked back at your previous posts and wondered how many times you have met, implies once and you submitted flight itinerary and 6 photos.

OP, sorry you’re case is taking longer than usual. My fiancé is also from Nigeria. I don’t have much advice to give you. Usually USCIS does give an update when the response to the rfe is received. 

 

In any event, hang in there. If you two met the requirements you have nothing to worry about. And the requirements only state meeting ONCE in the last two years. You could have an issue at the embassy for only one meeting but that’s not the stage you’re at so it doesn’t matter for now.

Well, I agree with others that you do need to do extensive research before mailing or submitting via online anything... It is unfortunate that it takes so long but most of us have... I would check USCIS processing time to measure timeline: https://egov.uscis.gov/processing-times/

 

Extensive wait time is normal, and take comfort in that you’re not the only one. Continue to contact USCIS for more info. (Although they’re not that helpful) after my REF I just waited, and eventually received NOA2 according to timeline indicated on the link I posted. Good luck and continue to research!!

OP said Nigeria and not Ghana...You should be fine once you respond to the RFE..Just try to more research on the visa you guys are applying for so you won't run into issues like this again..The Lagos Embassy have been doing a lot better when it comes to approvals..I love it how people throw up high fraud country, but a high fraud country where people have been getting approved left and right..Good luck on the rest of your journey OP!

At least you got RFE, you still have a chance to prove on your relationship.
