Hello,

 

I'm filing for my spouse who overstayed his visa. We got married in May 2019.

 

I've filled out the forms and checking for the supporting documents but I want to make sure I have the right documents. 

 

This is what I have so far. Any help is appreciated. 

 

I found this cover letter online which in using for the listed forms.

 

This is what I have for the rest.

 

I-130 

Filing fee

I-130 form 

Marriage certificate 

Passport photos (2) each

Affidavit of bona fide marriage 

Birth Certificate for both

 

I-864

Filing fee

I-864 form

Tax return for last 3 years

Proof of address for beneficiary

Birth Certificate

You can forget about that cover letter, it's pretty outdated. The fee is now 1225$, if you file for you only. And the documents to attach are pretty different.

 

Try to get as much information from the USCIS website directly. And get the forms from the USCIS as well not from other websites to be sure you have the latest ones. Download the instructions for each form too.

 

I can post parts of my cover letters tomorrow if you want.

 

Is it for a k-1?

Yes, sorry to confuse you, my recent post was not for this post, it's for another post but I already removed it. :) Anyway, I agree on what you said to OP. Recent forms should be checked most especially the fee. I had experienced before when I'm just submitting my K1 visa packet, my husband got the wrong fee on my check and it was returned. Regards.

I thought I was going crazy 😂. Btw the bouncing check happened to me too but for the AOS 😉

Just to be sure because it is also very confusing, are you adjusting status from a k-1 because you mentioned a I-130 🤔 I think we need to clarify the situation before we can help you.

No there was no K1. We got married, he's on an overstayed visa. I wasn't sure exactly which forms I need or don't need. 

 

I had asked a few weeks and was told

 

I-130

I-131

I-485

I-765

I-864

 

I looked them up on the uscis website and I was checking for a checklist and found the one I posted. 

 

I don't want to send the wrong info so I'm just a bit worried.

since it's spousal petition, you need also the i130A and the i693 which is the medical and vaccinations

 

the confusing part that what you posted is for k1 beneficiaries, and not for entering on a tourist visa and overstaying, so there are forms that aren't necessary and pertain to the k1 beneficiaries.

 

plus you are missing more proof of bona fide marriage.

 

for the i864, another birth certificate and proof of address isn't necessary, but copies of W2s and paystubs as well as the taxes are needed.

I'm not familiar with the procedure for adjustment of status other than with a K-1, especially with a notion of overstayed visa. My advice is to really look onto the documents and the instructions exactly what you need to submit. It may vary a little bit, depending your exact situation, you might have to add some more documents. But the I-485, I-130,  I-765 and I-131 are a good start. When you get the forms https://www.uscis.gov/i-485 for example, you also have instructions to download. Take a closer look to them, I know it's not always clear, but it says everything you need to attach to your petition.

Maybe someone can help you better than me on this matter, but my best advice is to get the most informations from the USCIS, don't precipitate to send the documents.
