B2 Visa revoked , applying for AOS

Fill it out, have someone proofread it, then send it along. Seriously, it took us a day. We did it the week of the wedding and we never got an RFE or anything. You don't need affidavits and even if you wanted to include them, it takes 1-2 days to send mail between states. 

Are you not suppose to include sone evidence of your marriage in your packet or is that just for the interview? Excuse my ignorance but What does RFE mean ?

For AOS, no. We just included our marriage certificate. Evidence will be brought to the interview. My husband already has his EAD card/AP card so we were fine. Double check on what you need for the I-130 or the overstay waiver though.

 

RFE is the note you receive from the USCIS if you are missing or misfiled a form. If there is an issue, you give them whatever they want, and as long as it's okay, you will continue moving on in the process.

Also, evidence isn't too difficult to gather. Show combined health insurance cards, leases/mortgages, joint statements on bills, cars in both names, bank accounts. That's the kind of stuff you need and doesn't take long to get. Most things are likely in your home and you have months to collect this.

Depends on the basis for AOS. In the OP's case, they need to provide an I-130 as well, which does request bona fide marriage evidence.

They usually aren't too strict on that for concurrent filers, though.

Don't worry too much, @Nikki123. If you don't do anything wrong, you are OK and you won't be deported.  

The sooner you file the safer you are. However, collect the needed documents as many as you can.

Right now, the AOS process is very slow. If you get some RFE, it will cost you more time. Read the forum and search,

you are good to go.

Thank you so much @Iaufune, we've been stressing so much for the last couple of days , we just don't want to make any costly mistakes by rushing it, thank you so much for your reply
