Read it again, give them immediate reviews for eligibility, screen off the 5% actually seeking asylum and immediately deny and deport the remainder

I would add anyone who doesn't enter through an official point of entry is automatically denied asylum.

This lawsuit brings to mind the classic definition of "chutzpah":  a boy murders his parents and then demands alms because he's an orphan.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

But my point is... why aren’t they ALL eligible?  They are all running away from persecution, aren’t they?  What separates those true asylum seekers from those just trying to get into the US illegally?

The reason they are fleeing, economic opportunity is not a legal avenue for seeking asylum, there have been several interviewed that state better financial options, not an asylum category

The migrants say they are fleeing persecution, poverty and violence in their home countries of Guatemala, Honduras and El Salvador.

"Today, Mexico extends you its hand," President Peña Nieto said.

But he added: "This plan is only for those who comply with Mexican laws, and it's a first step towards a permanent solution for those who are granted refugee status in Mexico."

The plan envisages:

  • Temporary ID cards and work permits
  • Medical care
  • Schooling for migrants' children
  • Housing in local hostel 

Meanwhile, Anna Lisset Velázquez, also from Honduras, told the BBC: "It's a kind offer - but it's not the plan that we have, to stay here halfway up."

However, another migrant described Mr Peña Nieto's proposal as a decent "plan B".

 

That does not sound like someone seeking asylum.

The problem is that Mexico takes the process seriously and very few would qualify.

So using what you and Randy posted, NONE of these people in the caravan would qualify for asylum in the US, since Mexico already offered it to them, and they turned it down to come to the US.

Sounds like someone who doesn't qualify for asylum in the US because they turned it down in Mexico.

That is exactly what I am saying. If the conditions in Mexico do not allow for Mexican citizens to seek asylum in the U.S. Someone who refuses asylum in Mexico is not really seeking asylum. They are looking for a better economic situation.

Granted that, after the consulates, CBP is our typical line of defense.

Granted that they see a lot of weird stuff.

However, most whom I've encountered (many dozens) are in a foul temper and are looking to nail somebody.

The so-called "peace" officers in the De-Constitutionalized Zone (<100 mi. of southern border) are even worse.

On point re the thread:

1.  Someone close to me deals firsthand with a lot of asylum-seekers, every week.

2.  The Central Americans' stories of woe are typically weak.

3.  The CAs have little, very charitably speaking, to offer the U.S. if they're admitted.

     The Venezuelans, conversely, are another story entirely.

Piggybacking on the above... the following presumes that U.S. law or policy precludes simply turning illegal crossers back across the border or permanently barring their entry on administrative grounds, no matter their stated excuse.

 

It's possible that the shooting deaths of a couple of these people, especially if they first attacked agents/soldiers with rocks or anything else assaultive, would make it clear (via news channels and word of mouth) that open entry to the U.S. is not worth the attempt.

 

Of course, some here would go absolutely "aysheep" (Mrs. T-B.'s pronunciation pertaining to the intestinal output of simians) if this were to happen -- probably rioting in response -- and the usual international condemnation would also result.

 

Also of course, the invaders could prevent themselves from being shot-&-killed if they used their children as human shields, and some would surely do this as they forded the Rio Grande.

 

What level of force is appropriate?  Might tear gas or rubber bullets be a first option?
