I agree with that, and have come to the same conclusion as well. Right now it is a waiting game until we hear back after the application has been submitted.  I'm aiming to get that sent out early next week, and then the 5.5-7.5 month wait starts.

We are going around in circles but you can not get there without resolving the Divorce issue.

K-3 is obsolete.

It would have no "reduction" or other impact on the ability to obtain the visa.

There are lots of good advise here. However, just want to add one thing. I feel like lying to immigration to get a visa is one thing. Another thing you need to prepare is proof of relationship. I know it is not related to what you are asking for. However, since she even willingly lie to get a visa to States before. The CO might think her intention is just to go to America not really in love with you (fraud).

I apologize. Don't listen to me and delete my post. I just dislike USCIS. Bad advice although I would file for CR-1 rather than K-1 in this situation. Don't lie to the government but don't give up information unless requested explicitly.

Agreed, there has been a lot of good advice here.  One of the aspects I'm documenting is proof of relationship, photos, chats, plane tickets, etc.  Since you brought it up, do you have any recommendations on what i should compile?

I apologize if I missed it, but how much time have you actually been together?  Have you visited her country?

I've been with her for 3 months, the last two weeks before she left, she stayed at my house.  I am planning to go to see her in January.  I'm getting my tourist visa in December and booking the flight then.

Can I ask, who she was trying to come here to visit for 4 times?

Did the Agency she used on the 4th recommend to her to check the married box on the application?

 

I'm just asking cause if she reaches the interview stage, she better have a good reason for the constant attempts, and it does help a lot that she didn't over stay, which was likely the reason for the first 3 denials.

Great! More visits and more time together equal better proof of bona fide relationships.  It is the strongest evidence you can provide....

More time spending in person is the best way to proof your relationship is real. Just curious, I know that you guys meet during that 6 months. When did you propose? Is it during that time too? 

 

I'm really sorry to say this. However, how can you be sure she is with you with a right intention. I'm not judging her. Everyone make mistake. But, there is lots of people who willing to do anything they can to come and live at States (including pretending they are in love). You don't have to answer this question here. You can answer it by yourself and if you are really sure she is the one. Proceed with the Visa process.
