Thanks for the replies...

On a side note, just went to the Chinese consulate here to get my Visa for my trip next year.  Looking forward to seeing her again, despite the unfavorable future.  All I can do is make the best of the situation and enjoy my time with her.

I oscillate between having no hope and a lawyer pulling a hail Mary. 

Ugh.

What I love so much about this process is that if she had $500k it would be no problem and she's have Visa, Citzenship before you can say, Show me the Money.

But I digress.

 

I think in general, whenever you need an explanation, no matter how simply one may think it is, it's time to get an attorney.

Quick and crazy question...

If she can marry the guy from her tourist visa and get a divorce, would that solve the issue?

The dates of marriage and divorce would be after the date when the fraudulent tourist-visa papers were filed.

You're seemingly trying to manufacture a feasible case when "the truth will out."

Attempts at deception or making "end runs" will ultimately fail, and then you're hosed.

Far more feasible is for you to move to China, or for you both to move to a third country.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That's what I thought as well.

I've found a lawyer that seems to know what he's talking about and has had some good experience with waivers. 

In the new year, we are sitting down to go over the DS-260 and have appropriate answers.  

I know it's not a guarantee, but I want to exhaust all options before moving out of the US.

No.  It could make things far worse.

 

-The date of the "marriage" would be after the date she claimed she was "married" for the tourist visa.  Easily found out by the CO when comparing past and present info submitted.

-She would possibly be committing immigration fraud in a round-a-bout way, considering she would have only "married" and "divorced" the 1st man in an attempt to later gain immigration benefits through you.

-If the first "marriage" was then discovered later on to be a lie/false when reaching the AOS (green card) stage, the IO could then assume YOUR marriage to her is fraudulent as well.

 

Compounding lies with more lies hardly ever ends well.

July 21, 2017 (Day 07) -  NOA Receipt received in the mail

July 28, 2017 (Day 14) - Biometrics letter received in the mail, appointment for 08/08/17

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

Aug 14, 2017 (Day 30) - Online EGOV status shows "Interview Scheduled, will mail appointment letter"

Aug 16, 2017 (Day 32) - Online MYUSCIS status shows "Interview Scheduled, read the letter we mailed you..."

Aug 17, 2017 (Day 33) - Interview Appointment Letter PDF posted online---GOT AN INTERVIEW DATE!!!
