I 134 is unenforceable.

Possible, but by far that's the minority of cases. More often than not, the issue is strong ties, not the public charge issue (roughly 90%+ of tourist visa denials are for 214b).

Yes....a simple statement on the DS-160 where it asks who is paying for the trip is sufficient. They don't need an affidavit, bank accounts, etc. to show that they will buy tickets (not that buying tickets really matters as it's not  a public charge issue anyway), let them stay at the house or buy a hotel, etc.

But again, the public charge concern is the crux of the issue.

As stated, the -134 is unenforceable as well.

Exactly. And unenforceable or not, an I134 indicates that there is at least one person resident in the US that the applicant has a strong tie to.

You all make it sound as if you have ties to the US that its 100% bad .

 

What about people visiting family like the OP said, sisters, cousins, grandkids. I would think some major of people come here as a tourist because they have ties here. Are they all rejected JUST because they have ties to the US ? 

 

I personally have family that comes here on a b2, my ex-GF was here on a B2 and half her intimidate family was living here in the US as citizens and GC holders.

 

That said, I don't know if an i-134 was filed for either:rolleyes:

Because that shows she has more ties to the US, not her home country. It comes from her own merit, NOT yours.

So we ended up filing TWO I-134, one for my wife, her daughter, and me, her son-in-law. She was approved for her 10 year green card! We were thorough in our records, and we taught our mom the Thai phrase for “everything you need to know, my daughter put in these papers” she literally answered almost every question with that phrase. They went back and forth for a while, then they allowed my sister-in-law, who speaks Thai, to come in and answer a couple of basic questions in Thai. 

 

It it sounds like we were extraordinarily blessed in this situation. We are grateful!!!

10 year green card?  I-134?  What?  How did we get from B-2 to 10 year green card in one month?

This is a highly confusing post. What do you mean she was approved for a green card. They do not give out green cards for visitor visas.

 

Also, the I-134 was a waste because it is not enforceable. You filled them out for nothing.

 

But if they were approved for a visitor visa, then congrats.
