Sort of on topic - What would you fill in for the I-485 for Question 24 in Part 1 that asks what your current immigration is? (for someone who came here on a K-1, got married within 90 days but, with an expired I-94?) Would we put K-1 Visa Holder or Out of Status?

Just put K1.

So you're saying since we don't have the DS3025 that we should just submit the I-485 without her medical and just wait for the RFE? I want to sent out the I-485 this week and I don't think we can get a medical done so soon again, and I don't want her to get shots she already got.

I would not recommend you do this as it is a mandatory requirement to have submitted either the DS-3025 or the I-693 with your AOS filing. Since they have recently passed a law were adjudicators can use their "own discretion" by denying petitions with sending RFE's as of 9/11, you don't want to run the risk of having your petition denied for something that you know is a requirement. Not saying you will get a flat denial, you can get a RFE, but considering the waiting and the new procedures that in a effect, I would err on the side of caution, that is my opinion; you can do as you please.

See if your wife can call the medical office she had her medical exam and see if they are willing to fax or email her a copy of her DS-3025 if you can.

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

Thanks for the responses. Had one more question:

The I-485 requires a I-864 (Affidavit of Support). Can I send a copy of the one I sent to her for her Visa interview which hasn't changed at all over the last 5 months? The date for the signature is 5 months old, but I could just reprint the last page if need-be so I can sign it with a fresh signature.

The I-864 must be an updated completed and signed version submitted. Some of your financial documents might be the same, however, it would be recommended to send an updated employment letter of verification with a updated date on it, and most recent paystubs that you received since submitted the I-134 during the K1 process.

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

It is not recommended (and I believe it's in the TOS on this site) to "hijack" another person's post with your questions, especially since you have already created a thread with the same questions, and the answer was given to you in your post. Just letting you know before an admin/moderator sees this and deletes your post. :D

That is fine. I still thought it was somewhat relevant to the post. I was replying to a reputable member here and like I said, I didn't think my question was random enough to warrant a response. Sorry to offend you! OP, I apologize. Thanks for letting me know! Sincerely. Oops....
