No evidence for AOS package

My understanding is that the initial K1 petition is the part that satisfies USCIS that your relationship is legitimate. They can see that you are adjusting from a K1 in your I-485 petition, therefore you've proved you have a legitimate relationship with your K1 visa photocopy.

We married May 20th and sent our stuff June 12th. During that time my husband added me to his insurance and we opened up a joint bank account so that is all we sent including our marriage certificate.

For example, my husband's bank made it a real pain to have me added to his account and it took a few months before we could do it. I agree that they can wait.  But there are documents which can easily be generated in a short time if that is what a person wants to do.....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

what we were asking is that should we wait about a month or two until we do all those stuff that you stated and then apply for AOS, or just apply with no evidence and then gather them for interciew while risking getting denied for no evidence..?

We only put in our marriage certificate no additional evidence. It didn't even occur to me to do otherwise because we had only lived together for less than a month and I own my house. 

 

We had all the other evidence for our AOS interview 7 months later. We were fine and my husband was approved no issues from a K1.

We did not submit any evidence with out AOS packet outside of the required marriage certificate. They don’t expect a lot for K-1 applicants because you are new to the country and to the marriage.

 

We were approved without an interview, so in the end no evidence was needed for us. I would suggest submitting whatever you have now and then just be mindful about setting up financial ties going forward for when you are asked for an interview later on. Getting things set up earlier will also save headaches in the future and help ROC go smoothly in 2 years.

My husband and I filed our aos in September we got married in January and live with his parents we only contribute to groceries and the Bills we do not have any Bill in both our names.  We only sent a bank statement, copies of cards we got from family members as evidence I did my biometrics last Friday.

Yes and no. They assume some legitimacy, yes, but now they interview all K1 AOSers so it's better to have some "paper proof" of financial co-mingling by interview time.

But that's when the interview comes, which is a while down the line. For the initial filing, you don't need any of that. We, among many others, sent the required papers and our marriage certificate. No RFEs. We wanted my husband to get his EAD and AP as quickly as possible, so we didn't want to wait. We sent the AOS paperwork the same week as our wedding ceremony, so we didn't even have anything co-mingling together yet.

For sure. OP should file now & send the marriage certificate. Gather evidence for the interview later.
