As far as I've read, you wont need that kind of evidence until your interview occurs. I dont believe it's sent in with the aos package. I know we have been set for our interview and we should have all evidence by the time the interview happens. We only sent marriage certificate along with other basics.

FYI all AOS via marriage applicants get an interview now, but it had not always been that way, hence several comments from people who applied for AOS after entering on K1 & marrying their petitioner and NOT getting an AOS interview.

Dear all,

we were wondering about the AOS evidence of relationship that we should include in the AOS package.

right now, we have nothing except our photos. no bank account, no joint bills, no insurance beneficiaries.

should we be worried?

should we postpone filing until we do all the stuff above or send the package with  no evidence?

some posts states one or the other option so we are confused.

thanks for the help

Are you adjusting from a K1? You don't need to include any relationship evidence with AOS, just a marriage certificate. That's what I did and our interview was super easy.

don't worry about that for now. Just file and do what they ask (marriage certificate, maybe wedding pics etc) We didn't include any other evidence beside the paperwork (no pics, no stuff for bonafine relationship)  when we filed. I will bring the rest of it to the interview when it happens. After filing go and try to get a joint bank account (and also use it....) and other stuff.

hmmm.. i guess we don't have another solution except waiting a while  before aplying but i guess that we will go ahead and follow your advice

You don't need to send the evidence. You'll just bring it on the interview which will be around 9-12 months. We have our interview 9 months after filing. That time will be enough to acquire evidence that you are living together.

You are Adjusting from k1 and living only for a week. Don’t worry file now with whatever you have. Even if it’s just the marriage certificate cause that is the most important requirement.

most k1 doesn’t have evidence at the time of filing but their certified copy of marriage  certificate, you will be preparing evidence for your interview.

good luck :)

You don't need to send any other evidence other than the marriage certificate. We didn't send anything. We also filed AOS the same week we were married to get everything going. Just submit it.

No!!! Don't wait. You can even read the guides here on VJ, you don't need any relationship evidence if you're adjusting from a K1. If you get an interview, you will need evidence then but you have a lot of time till then.

OP will definitely get an interview. After a fairly recent change, all marriage based AOS applicants get an interview, including those who entered on K1.

sorry we forgot to mention that we have been married and living together one week and we are planning to rush the filing of AOS so we don't loose time waiting. in one or two weeks, it is impossible to have any of those evidence.

what we were asking is that should we wait about a month or two until we do all those stuff that you stated and then apply for AOS, or just apply with no evidence and then gather them for interciew while risking getting denied for no evidence..?

You can open a bank account in an hour.  You can create health proxy statements in a day or so.  You can create a will in an hour.  You can use any document which shows you both living at the same address........just a few ideas.

nope cz house is owned by the petitioner.

Have him look into something called a "quit claim deed". It allows you to be added as a titled owner. They're only about $10 in NM. Not sure what they cost in other states.

Second that.

All you need to submit is your marriage certificate.
We added like 6 photos of our wedding (just 3 per page, printed on paper).

That's it.

Start mingling your finances and all other things now. They will ask you for it at your interview.
I had mine 2 weeks ago and they kept copies of all things we brought.

But for now: You're fine, don't worry.

Yes, but it's not necessary to do it all in a hurry when they can just send the marriage certificate only and have zero issues. For example, my husband's bank made it a real pain to have me added to his account and it took a few months before we could do it. That's the bank he'd been using way before I moved and it wasn't actually meaningful for us to create a bank account with a totally different bank where he didn't have anything. We actually wanted to comingle our finances and it only made sense to use his already active bank account for that. And there's no need to create wills in a rush. They have a lot of time before the interview to prepare everything, they're much better off just sending the AOS package as soon as possible and start collecting evidence after that.
