USCIS claims I’ve abandoned my case

I recently received a RFE for my I129f back in August and submitted the required evidence, it’s now October, I followed up with an inquiry, I received a response stating

Text:

On INSERT DATE, you or your representative contacted USCIS concerning your INSERT FORM TYPE to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved. 

On INSERT DATE, we sent you a [Request for Evidence (RFE)/Notice of Intent to Deny (NOID)], affording you [84/30] days in which to respond. We did not receive a response from you within the time allotted. The notice was sent to the address on file, and our records do not show the U.S. Postal Service returned the [RFE/NOID] as undeliverable.

Therefore, we denied your INSERT FORM TYPE on INSERT DATE. Please refer to the Denial Notice for any information about your available rights or motions.

 

I am very confused because I submitted the required evidence and have tracking to prove they received it. Yet they claim I didn’t submit it, I called them and they told me it shows that they received it but yet the response to my inquiry states that they never received it, what can I do?

If it's abandoned, you might need to apply a new petition again as it's not gotten approved.   I hope you good luck.😊

No, you don’t have to submit a new petition. Contact your elected congressman or senator and have their immigration aide fix this for you. You have proof it was received, have USCIS reopen the wrongfully closed case free of charge.
