Need Help/Tourist Visa/k1

Timeline

Same religion, male is older & a USC, as well as female is childberaing age, and Moroccan. Very different circumstances than most cases going through the Moroccan US Consulate, I would say you stand a decent chance of getting a K1, but just to avoid any risk, I would advise you to marry & file for a CR-1 instead.

Exactly, I do not think that there would be a denial, for all of the reasons you mentioned and also because they have known eachother for three years. Either one would be okay I think .

If you try for a tourist visa the Consular will ask you if you and your boyfriend have plans to get married.  If you answer Yes, you WILL be rejected and they will tell you to apply for a fiance visa.  

AOS Timeline (I-485, I-765, I-131)

 

12/28/2019:  Packages sent to USCIS via Fedex

12/30/2019:  USCIS received packages

1/08/2020:  NOA for all 3 applications

1/17/2020:  Received biometrics appt letter for the I-485 and I-765 (Code 3). 

1/31/2020:  Biometrics completed

2/20/2020:  RFE

6/15/2020:  Case is Ready to be Scheduled for an Interview

6/15/2020:  I-765 (New Card is Being Produced)

6/30/2020:  Received Combo Card in the Mail

4/22/2021:  AOS Interview

4/26/2021:  AOS Approval

4/29/2021:  Permanent Resident Card received in the mail

Your best opportunity is the getting married and filing the CR1 visa.  Like it has been pointed out K1 visa are hard to get.  Just compare the numbers in the reports.

 

CR1 does take longer but is has better success and is cheaper in fees. If it gets denied you can appeal.  Plus you don't have to wait for a green card and you can travel right away.

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

If you are successful in getting the tourist visa, you'll have the option of marrying in the US and then return to Morocco and do the CR-1. Check out thread below:

  • Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
  • Spouse can not leave the US until she receives approved Advance Parole (approx 3-4 months)

  • Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period.
  • Spouse will not receive Green Card for many months after Adjustment of Status is filed.

CR-1

  • Spouse can immediately travel outside the US
  • Spouse can start work if desired
  • Spouse receives Social Security Card and Green Card withing 2 or 3 weeks after entering the US

All-in-all, the CR-1 is superior to the K-1 imo.

CR-1 is vastly superior, cheaper overall and the spouse can work & travel immediately, as well as the clock for ROC & citizenship starts to count immediately vs waiting up to a year after marriage for a GC following K-1 & marriage.

This is true, CR1 is definitely the cheaper and better option of the two but in terms of approval, I believe that the chance of approval of a K1 in her case is good.

It is not issue for us if K1 expensive or not. The important that we get approved 😢 

Am just wishing to get Canada visa (tourist) once am there we get married and we apply for spousal visa? Can we????

Yes. With the CR-1 the legal marriage can occur anywhere in the world (US, Morocco, Canada, etc.)

What would the advantage be to getting married in Canada?  It will not make the overall process any faster than if you get married in Morocco. And you will still have to wait out the 12 month processing time in Morocco, and have your interview there.

Yeah I know that but to wait when when my fiance can be free is hard... Is not easy for him,  full schedule... So that's why if I get Canada visa(not sure) we get married there and we send our cr1 package... In Meantime we can travel together, meet in Canada...

Well of course.  There are any number of countries where you could meet to marry and have a vacation.
