Changing country for interview

Timeline

Hi I have some question about changing country of interview. My spouse is a Filipino Citizen and he is currently in Singapore. I filed petition 2016 and requested to interview him in Singapore. His case number is in Singapore. By next month he is going to resign and move back to PH. So I need to request to move his interview in Manila. Any members here been to this kind of scenario? What's gonna be the procedure and how long it takes to change his case number from SGP to MNL?  (if they are going to change it) His PR date is nov 2016 and currently processing is AUg 2016

If the petition is still at NVC, then contact NVC (you can use askNVC) to change the embassy to Manila.

If the petition is at the embassy already, then the process would be to contact Manila and request a transfer of the case from Singapore. How long it takes depends on embassies involved...transfer from Riyadh to Manila in 2017 took us ~2 weeks. YMMV.

We did a K-1 visa, so we do the DS-160. We decided to transfer before we filled out the DS-160, but if we had filled it out beforehand, we would have just done a new DS-160 for the new embassy.

Where is your case file currently?   Are you processing at NVC currently?   Requesting a change of embassy while at NVC may get results but more times than not they still send the case file to the original embassy.

 

If NVC does not forward the case file to Manila you and/or your husband will have to contact USEM to request the case file be transferred from Singapore.    You can expect at least a 2-4 week delay from when the MNL requests the case file transfer.

Hank file case country is in Singapore and will transfer it to MNL. Right now the documents is still in NVC.  Do I need to include on the letter the reason why he is going back to PH? or Just request to reassign the  case from Singapore to Manila Consulate? Aside for birth certificate and passport , what are the best proof of residency and country of citizenship that I can send?

There is no harm in including the reason for requesting the change of embassy in your letter, but like said, NVC is not very responsive to these requests so be prepared to contact the USEM to request the transfer from Singapore.   

Proof of residency & citizenship?  Who would you be sending this too?     A passport shows citizenship.  Residency is different, you show that by evidence of where you live; lease, deed, utility bills and such.

 

One more thought.  It would save a lot of time and hassle if your husband can get a police clearance from Singapore before he leaves as it will be need by USEM.   He may have this already if you are currently processing through NVC

Hi it’s me again my spouse already got his p4, interview will be on Feb, My question is about federal income tax return, can he present  the last year filling if I wasn’t able to receive my w2s early? That will not cause him any delay in processing his visa?
 

Second question, if  visa was issued in US Embassy SIngapore. Is’t  possible that he will come from  Manila to US instead of SG to US? If yes does he need to have his PDOS?

Most recent tax return is from 2017 tax year currently.  2018 tax return is not required until after 15 April 2019.   Thus there is no issue if you don't have your 2018 W2 ;) 

 

If your spouse wants to fly to the Philippines before flying to the USA that is not an issue, and yes that would then require that your spouse complete PDOS before being allowed to leave the Philippines.

Answer:   The following are the Filipino migrants who are required to attend the CFO-GCP:

  1. Fiancé/e/ spouse/ partner of Foreign national; Not this one
  2. Fiancé/e/spouse/ partner of former Filipino citizen; Not this one either
  3. Fiancé/e / spouse/partners of Filipino with dual citizenship; Strike 3

 

The OP's spouse is a current Filipino national with Filipino citizenship. None of the cases above apply to them, therefore GCP does not apply.

Was the OP a current filipino citizen? The spouse being the one having been petitioned by the OP who is currently LPR out of Singapore where they filed the initial petition that does sound like a spouse or partner of a foreign national unless they were also still a current Filipino citizen at that time, however if not then ok I'm wrong, but it didn't sound that way from the OP.

The OP's case (as indicated in their profile and timeline) is F2A, which means they aren't a US citizen (and almost certainly not a US national). So the ways to meet any of those 3 conditions would be risky assumption, but not certainly not impossible either. They could be a non-Filipino national or have dual citizenship elsewhere. My above post incorrectly assumed the spouse was the petitioner.
