Unless she doesn't want to leave. She's not a package and the OP has no way to ensure she returns home.

She would be staying illegally and it is not the OP's issue anymore at that point, but it is a possibility that could occur.

Ok i will be more careful in future...I joined this site to understand the process of getting married to my cuban girlfriend. Although my feelings are true she may not be true she lives in Holguin on the out skirts where there is nothing.. I went to Habana and was not impressed and she thinks the world of it and of foreigners. She was married and now divorced which is a red flag? How can i find out if she is still married?

I actually think it's smart to look at what can happen. I'm the one who moved here with my 4 kids and gave up my life in Canada, sold my home. You bet your bottom dollar I looked into anything and everything. All the what if's I could think about. In this day and age it's nuts to go jumping into something like marriage blindly then add immigration to the mix.

 

How many times we see on here where they split up and try to get out of the AOS, and they want to ship them back? It's daily just look at the comment above how you can use the 90 days to try it out and send them back if it won't work. We all know full well that is not what the 90 days are for but ppl still give that advice and ppl still think they can do that. He's being smart thinking with the head above his shoulders for a change.

Perhaps "Offer a plane ticket home and try to convince him/her to take it" would work instead of "ship them back".

I recommend you join CubaAmor.org and tell your story there. You can get more informed advice there as to what constitutes a red flag. I’ll warn you (as someone happily married to a Cuban) that the crowd can tend to be very negative.

A quick way to find this out, is to tell her you'd rather move to her country instead and get away from America altogether.

 

If she begins to think about possibilities/how to have you move there, talks about the life you'll have together, wedded bliss, that's a good sign.

 

If she immediately balks at the idea and comes up with every reason why she should move to America instead and tries to convince you no matter what you say, that's a good sign she might be in love with your country, not you.

You are not sure to marry your girlfriend and not sure if your marriage will last in case you'll marry her. Get to know her more first and then decide. Marriage and the entire visa journey is a serious path that requires mental,emotional and financial responsibility.

Take your time there is no rush to marry. Have a few more visits. Marriage is not something to take lightly.

You have too many concerns about the validity of your relationship and possibility of being scammed to also be someone who is ready to marry the person and commit to that kind of a relationship. Spend more time together and determine if the relationship is legitimate, or if you are being scammed/used. Until that's been put to rest, there's no visa that will work best for you because a scammer is a scammer, and it would end the same way regardless if it was with a CR1 or a K1. Just my two cents.

 

The mindset that the K1 gives you a "90 day trial period"....? LOL. Sure, that's what some people use it for. But that's not what it's for. It isn't a trial membership to a gym or club - it's a human being and (what's supposed to be) a valid engagement. You're supposed to already know you intend on getting married before you even apply. That's why it's called a Fiancé Visa and not a Trial Relationship Visa. They aren't sweaters or luggage you can just return to sender. Plus, as others have already pointed out, financial sponsorship is required on your end whether you did a CR1 or K1. Only exception is if you, independently, do not meet the required poverty guidelines, in which case you would need to find a co-sponsor. That responsibility is still with you, though.

I always say "go with your gut feeling" because there is a reason you are not completely sure about what to do.  Take your time and don't rush into anything.  If you both really love each other, she will wait until you are 100% sure about getting married.  It's a lifetime commitment.  Best of luck to you.

I met her 1 year ago and we started emailing each other everyday then calling on the phone but that can get expensive and so we started free video chat on IMO about once a week. I started sending her money for this or that and now what i thought was just to help is now like a little rent each month. I dont mind because i care for her. I visited her twice this year once for 7 days and the second time for 11 days. I have only met her aunt because she lives on the outskirts of Holguin. I was initially really ready to get married but lately i thought what if the only reason she speaks to me is for that little rent i give her? Because there is money involved validity of my relationship might be completely false. My plan was to hold off a bit and go stay in cuba for 1 month in her home town see if her family embraces me and see if there is no boyfriend anywhere in the shadows. This is cuba and it has a really bad rap as to people scamming and that couples encourage each other to scam tourist. It feels real to me.
