Hello all!

My fiance is from Australia, and we are currently awaiting our NOA2. Based on processing times at the moment, we will most likely receive that next month (NOA1 was March 8, 2018). 

 

However, we have been planning from him to visit here over the holidays, from November 20th - January 1st. Will this cause any problems with the next steps? We were hoping that he would be able to do the interview in January, once he returns to Australia. Any clarification would be appreciated!

Visits are fine as long as your visa hasn't been approved ( or it isn't after the interview because they will keep his passport).

 

My husband went through the Sydney Consult for K1 and if the times are anything like ours were about 1.5 years about he could possible have his K1 visa by that time which would mean he cannot visit because once it is issued his next entry would have to be on his K1 for marriage.  

 

You can try and delay the interview a little bit but you do have a time frame before the NOA2 expires (but I believe it is 6 months but you would have to confirm this).

I went to the US for just under 3 months on the I-94 visitor visa after we got the NOA2 and were waiting for the NVC to begin the visa application process (submitted the visa application online from the US). There were no problems but make sure that you have a return ticket and under no circumstances consider working. I also had a letter from my immigration attorney and a copy of the NOA2 but it wasn't needed.

Thank you both for your responses! We booked his flight today, including the return flight on Jan. 1st. He still has an active approved ESTA valid through March of 2019 (and a job to return to in Australia) so I think we'll be fine.

Just make sure he doesn't have his K1 visa issued yet, once the K1 is issued, it will override his ESTA :)

 

My husband visited me in the states the day after the NOA2 was approved, there were no issues at all. You just want to make sure you don't have a K1 visa issued yet. 

 

We had to delay the K1 visa medical and interview by a couple of weeks because of his timeline that he planned on entering in the US (AKA finishing up work and doing a family trip and the timing of our wedding) We were going to be close to an expiration date of the K1 because of how fast things were going to be, so we had to slow it down a little after the NOA2. We just made sure we paid close attention to deadlines and expiration dates if you think your NOA2 will be next month. :) You should be fine but it's good to just be aware if you are trying to manage a tight timeline in the NOA2 phase :)

i have your same issue;

 

i'm going to visit my fiancè in US for about 3 weeks in end september

 

we already received NOA2, 2 days ago

 

i've read somewhere that NOA2 has an expiry date of 4 months (unless the embassy delays it)

I've looked into this a lot after I initially created this thread. The NOA2 does technically have an expiration of 4 months, but depending on the consulate you are dealing with these are automatically extended or you can request an extension. It seems that it is not all that difficult to delay the K-1 process (moving to another country permanently is, after all, a huge undertaking). 

 

As long as you do not have the actual K-1 visa yet, you can still visit with your partner as long as you have another valid visa or visa waiver. Sounds like you will be completely fine, especially since your intended visit is less than a month from when you received the NOA2.

Why do you think is a problem if you visit a month after the NOA2 ?

 

Did you read anywhere that is a possibile issue? because basically im going 1 month after (about)
