HELP HUSBAND DENIED VISA UNDER 212 A 9 B 11

Visitor he left to go to Mexico for his embassy appointment we already had an approved I-601a and I thought we were good but that did not even work I had presented the reason for my hardship and they did not even care I have AFIB and my stress is really bad right now I am scared to have a stroke . But again I proved all that to immigration and we paid over 600 for that form and nothing worked . I am a US citizen born here . There has to be a loop hole or a form I can file right now to get him back .

I 601a is limited in what it will waive, does not waive 9C

 

For them to care you have to be first able to file a waiver. Not currently eligible to do so.

There's no loophole that's legal. 

He triggered the 10-year bar when he left the USA.

With a 9C bar he has to wait out the 10 years before even applying for the waiver...there's no legal way around that waiting period with the type of bar he has.

 

Even with the i-601a being approved, your husband would have automatically triggered the bar the moment he left the States. 

The approved i-601a helped waive the accrued illegal stay/overstay...but an approved i-601a does not waive the multiple illegal entries from before.

A 9C bar is a lifetime bar for which you can only apply for a waiver after ten years of documented presence outside the United States. 

 

There is no way around it. Actions do have consequences, and this is one of them. And I say this not to be mean or belittling, but this is how the world works. You do A and B occurs as a result.

Thanks everyone this is very frustrating I am so heartbroken it feels like my husband died . I am worried if we don't figure something out I will become single and 13 years with a good man and now alone . Appreciate your help!!!

Have you considered moving to his country temporarily?

I have considered moving there but he does not want me to sell my house and property and loose all we worked for at a cheap price. Another thing is I would have to be stuck being a housewife for the first 2 years unless I had a job going over there which my job is not willing to let me transfer.  So to rely on 1200 pesos a week to support us both is very little. I am trying to figure it out as of now I can always fly down there and use my vacation time to be with him..Hope something comes to mind soon on what exactly we will do.

I had my fiancé solo I-212 approved just recently in 97 days. You have a 212a9c bar and husband must reside in 10 years unfortunately. It’s possible to do this, have patience.

 

 Start gathering proof that he has been residing / working in Mexico, there is an awesome fb page group I212 in which everyone helps each other out. I recommend you join, if have questions I could help guide you, I did this all on my own , aside from the fb group who answered my questions.

 

Decide what’s best for you and family. You’ll still have to do an extra hadship letter with evidences, show Am inadmissibility blue sheet from Consulate Cuidad Juárez, and show proof your husband resides outside 10 years, make sure you explain your evidences on why you used them. I recieved an NOID letter ( Notification of Intent to Deny ) since my 17 evidences was not sufficient nor explained why I used them. I resubmitted 57 evidences with 37 new evidences and 5 page letter explaining my evidences. I was not questioned on my extreme hardship letter of 16 pages not 51 evidences with that. I wish you and family best

So a person can enter USA before 10 years with approval?

I 212 suggests a 5 year ban, but yes with a waiver.

I am a USC and also have Mexican Permanent Residency.   I married a Filipina and we decided to wait out a spousal visa application in Mexico.  She was given a Mexican Permanent Residence and Green Card five hours after applying.  See was offered a few jobs there.  Since you are married you should at least qualify for Temporary, if not Permanent, residence if you wanted to live there..  You could rent out your house in the meantime.

Thanks Paul and Mary I have decided to move to Mexico .I am over the shock of it now and am looking forward to being there although I will sell the house to have enough money to hang out a while. MY medicine and vitamins are to much money there so I will need to fly back and forth to US to get them every 6 months. As did not find anyway to get my meds shipped to Mexico I was told there a very strict rules . I will look for a US paying job after a couple of years.   I will look into the permanent resident visa .I know flying every 6 months they can also continue to give me the temporary one as long as I leave before those 6 months is up. My husband owns his house so no rent just a electric bill we still have no running water but hope to get that soon . Maybe the immigration laws will change after I am down in Mexico and we can come back sooner. (wishful thinking)

That is odd, meds generally speaking are cheaper everywhere else. Many people get their meds from Canada etc because of this.
