Even without the K-1, your expenses for travel will soon end. She's been spending more time in the U.S. than in Japan. It's only a matter of time before she is refused entry.

OP-

You said you will explain about the passport. I'm pretty sure they will not 'understand' as it's not their job. You need to submit your birth cert. for the RFE, that's it.

Yes she is currently in Japan now (She returned mid april), and it was previously decided that she would not return until she recieves K1 visa; I was estimating we would make some sort of progress towards getting the K1 visa.

Hopefully we are close to getting visa in a few months.

I think I have all the information needed for the moment. Thank you guys SOO much for all your help;

I will start gathering infomration for the NOA2 and documents I will need to send her.

I will be bugging you guys again most like likely.. Thanks again!!

Just to be clear - you have the choice of submitting all pages of a US passport OR front and back of your US Birth Certificate. There is no need to explain the lack of the passport - this is not their concern. You MUST prove that you are a US citizen in order for your petition to be approved (among other requirements). Therefore you MUST respond to the RFE and prove exactly what they are asking for. Chances are the wording of the RFE was something about a passport or BC in order to prove citizenship. No matter how they worded it, what they are looking for is proof of your citizenship. Therefore, provide the front and back of your Birth Certificate.

Are they asking you for a passport because you didn't send a copy of your birth certificate. If so, send a copy of your birth certificate and explain about the passport.

Just exactly what does your RFE say? Please be specific (verbatim, if possible) to get the best possible assistance.

Thanks for this response.. I think you all answered my question. Yes, I fogotten to put in my birth certificate when I filed for the her K1 visa. I dont know what I was thinking; I downloaded the forms and sent them in.. I didn't do extensive research at that time.

Now our relationship is getting very serious, me spending 1200$ every round trip tickets for her are starting to become expensive, and on top of this she wanted this to happen like yesterday. So I am trying to get my ducks in a row as soon as possible.

But I think I should be in good shape, thanks to all of your responses.

Regarding the RFE; unfortunately Im at the office at the moment and all my papers are at home. Do you mind if I send you a PM to take a look over pushbrk?

One again I am so greatful and extremely happy I was directed to this site; after my journey is complete I will try my best to contribute my experiences with others.

The omission of the birth certificate explains the RFE, so there's probably no need to provide more details unless they ask for more than the birth certificate or passport. Either will do. If they want something else too, send it along. If you have further questions, don't hesitate to ask.

What I was trying to get to the bottom of is whether they were actually asking you for a passport. Even so, the birth certificate will do.

Facts are cheap...knowing how to use them is precious...
