Marriage fraud? Need advice on what to do next.

The longer you wait to divorce, the more expensive it will be for you since she will be entitled to more of your assets.  I hope she is employed or you may find yourself supporting her during the divorce proceedings so make it quick.  Talk to your attorney but make it a win-win situation.  There are several good forums with family law discussions. Check those out.

Oh trust me it is fraud. I'm not posting all the details in this thread since I don't know who's reading but I have posted here under another name before and everyone pretty much agreed that it was fraud. I recommended counseling before and she refused. I know where she is because she came back yesterday. Once she left and I told her I was filing for divorce, she showed back up and now wants to work on it. Smh. I don't know what I'm going to do now.

A lot of K-1 visas had been approved without interview. Most K-1 to AOS don't have an incredible amount of proof since they're only married for max 3 months, minimum a couple of days.

I wish I could go back and see what we had for AOS, but I can tell you it was next to nothing since we had been married for a month at the time of AOSing. ESPECIALLY compared to what we have after two years of marriage.


One thing I am curious about..


You say you've been married for roughly 18 months, but she just got her conditional green card a month ago. Is the process that backed up now or did something happen to where ya'll delayed filing for AOS?

Seems like a really large time gap from K-1 to AOS.

We initially applied at the 5 month mark but our package was lost. We applied again and it took 1 year to be approved.

Since you're 100% sure it's fraud, makes sense to continue on with the divorce?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
