Timeline

Hi Everyone-  I am a November K-1 filer and after reading about John & Rose situation, I came to realize I may have made the same mistake.  I am absolutely panicking.  

 

In 2014 I received court papers in the mail for a misdemeanor property damage charge.  The sentence says:  stay of adjudication: entry of judgement is stayed for 1 year.  You are placed on probation. Successful completion of probation will lead to this case being dismissed.  

I was also fined restitution of less than $1,000 (which I was suppose to receive paperwork on but never did, called the courts a few months after to inquire about it and they told me my case has completely slipped thru the cracks and they will need to call me back. Never heard back from them nor received any papers) 

 

problem is i I checked “no”  on the I-129f petition 😩

 

what is going to happen now?  Will USICS catch it and deny it?  RFE?  Need to withdraw and re-file?   

 

I am just sick and heart broken over this. Simple honest mistake may have just cost us many more months of waiting 🙁.

The battery was a killer for the petition because it must be disclosed in accordance with IMBRA requirements.

It should have been declared on your petition, but should not be a cause to deny or invalidate it (maybe - but unlikely IMO - they will want to see the documentation).

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

4/6/2017: Received, 4/12/2017: Sent to Riyadh embassy, 4/16/2017: Case received at Riyadh embassy, 4/21/2017: Request case transfer to Manila, approved 4/24/2017

5/1/2017: Case received by Manila (1 week embassy transfer??? Lucky~)

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE

Timeline

Just gather your documents related to the case. You need to see where it’s at and what is the status. Surely they will want to see court records. Prepare now as if they already sent you an inquiry about it. Best thing to do is be proactive. Best wishes.

what is done is done....get a certified copy of the court transcript from the courts clercks office. your charges don't fall under the IMBRA guidelines. Not having disclosed it...now its up to the next step to either get RFE and then you get a chance to explain or at the embassy stage

9/5/2018                     We are still reviewing your case and there are no updates at this time (this is getting boring!!!)

10/3/2018                  We are still reviewing your case and there are no updates at this time (this is insanity, 4th time while some got GC)

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail
