Hello,

 

My I-751 is still pending filed on July 2016. I did applied for N-400 with pending 751 which was fine according to USCIS as I called them and confirmed before I filed for n400. My N-400 application was approved on time and I had interview. Something very unexpected happened. I went for an interview on time and they scanned my appointment letter and gave me waiting number same like other applicants. they called my number after 20 min of wait officer came out called my number from the door and said '' Sorry we can not take your interview as your I 751 is still pending. They asked me DID YOU COME FOR ANY 751 INTERVIEW BEFORE? I said no. lady officer told me '' you need to make sure that your I751 needs to be approved so if you receive second n400 interview '' DO NOT COME IF YOUR 751 is still pending" so contact USCIS and make sure that you complete 751 case. :-( They did not even called me in interview room. I already called USCIS about 25 times in past regarding pending I751 but they are keep telling me its under process and out side normal processing time. I have made 2 service request in past but have not received any reply too. Now after 15 days past from denial of n 400 interview I have received I 751 Interview letter which is in May. They have mentioned that I need to attend with my spouse and bring all proof since we filed for 751. they have mentioned in letter that the interview is going to be Video taped. I did submitted all requested proofs but still i do not know what else they need.  Can any one give me some more info about your 751 interview experience.  Thanks in advance

Hi i filed in April 2016 Vermont,  751 interview on November 19 2017

The officer was ok but not someone you can chit chat with. my case is a little different from yours, my spouse and i live in different states, therefore she asked why and it was because he had a better job offer and i was already in school..but we visit and stuff like that... She asked how many bank accounts do we have, where i used to live before we got married, whom i was living with.. my address now and his. His job, and mine...and how i get to school and work..

then it was over...she took some pictures, made a copy of our drivers license and cope of our passport, the page they stamp when you travel.

i haven't heard from them since until, i received the mass update that was sent out..."my case was received at my local office"

take every proof you sent and add anything new like your recent tax return transcript and pictures...take more pictures because you have time.

you will be find and if you are lucky you, they might conduct your N400 interview as well.

Thanks you for the update. 

Was your interview was video taped? and was it both togather or you and your spouse separate ?

They did mentioned in Interview letter that your interview is scheduled for official mater for 751 so I do not think that they will take 400 Interview as well.

Here you go. They  did not follow USCIS procedure. Those two screenshots are from the USCIS manual. They were supposed to conduct the naturalization examination. Ideally, your I-751 should have been located ahead of time and even adjudicated, if you filed a complete body of evidence of bona fide marriage. 

I do not like it one bit. I would reach out to your Congress person. #1 your I-751 is way out of processing times. #2 Congress ensures federal agencies like USCIS provide the services they're supposed to constituents. 

You were told YOU needed to make sure your I-751 was approved first. NOT TRUE. They have to follow procedure and take care of all that. They could have easily approved the I-751 and waived that interview. Then, invite you for the N-400 interview. Your spouse has to be present and you have to present evidence of bona fide marriage. 

Again, have your Congress person question the procedure they followed. You will see how quickly they back-pedal.

The above is correct - they screwed up by not following procedure.

Contact your representative AND the ombudsman.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

No chance.

They didn’t follow their own policy in multiple instances in my case - including issuing a denial without giving me an opportunity to answer and refute false allegations made by my ex spouse which were cited as the reason for denial.

They just don’t care.

I cannot imagine the level of stress that must have caused. I am sorry to hear that. I mostly meant they'll likely check in their manners and follow procedure if they know the Congress and Ombudsman are aware of the situation.

yes it was video taped, you have to go with your spouse.

i have heard of instances that people get both interviews done.

Thank you all for providing important information.

I have I 751 Interview in 2 weeks now. Can any one suggest me with list of Proof I should take in Interview. They have mentioned in letter that I need to bring all proofs After filed 751 date.

No, they point is they did not follow procedure and you were not treated according to USCIS policy manual. So since they did not follow procedure and what they told you has no basis on actual policy, it is worth questioning how they decided they would handle this case this way. Having no other information at their disposal, they basically LOOKED AT YOU, made a brisk judgment and decided to handle your case how it is being handled right now. Ask them if it's because you're indian or if it's because of the color of your skin and watch them $h1t their pants.

You can google how to contact congressman. Google is your best friend.

Never be afraid to assert your rights when it's clear that you are being singled out. You need a thorough table of contents for your interview.

Hello ALL,

 

Finally IT OVER,

 

So I had I751 videotaped interview after denial of N 400 interview last month. me and my spouse arrived at USCIS 30 min early. After security we went to interview line windrow where they checked my N 751 joint appointment letter as well as I showed them last N 400 too. They gave us token number and informed you will be called soon. After 15 mins of wait super friendly young officer called our number and from the starting point to the end she was super talkative and friendly.  She then took us to her office and told us that before you take seat you need to talk oath. After that she turned on the camera and took out my N751 and N 400 big thick files at the same time. Then she goes we will go through both case one by one. She started with what is your wedding date? where was it? how did you meet? when did you decided to get married? why you do not have kids? where do you work? then she asked for any evidence we have for our marital union. we provided with Car insurance,  last 3 years tax return, our Chicago, Texas and India trip tickets, pictures. Bank statements.  She said she can not approve i 751 but she is going to request because her system is down at this time. then she goes now we will start with N 400 I was in impression that she will not take exams for 400 because last month during my official N400 interview date they denied to take my interview because 751 was pending. 

In N400 mostly she went through my form which I sent. She asked all those questions again and then she took writing, reading and history test. She just asked 6 questions in test and she said you got all 6 right so we are done. Officer provided me with form N-652 which says my A number and CONGRATULATIONS! YOUR APPLICATION HAS BEEN RECOMMENDED FOR APPROVAL. She said because we need to stop your new green card process we will not be able to put you in next Oath Ceremony but most probably you will be schedule for last week of June. 

 

Thanks every one for providing all important info during journey from VISA to N400.

Congrats on finishing your journey! I have a quick question: when you received your I-751 interview notice, was it mentioned that you will also do your N-400 interview or it was just for I-751? Thanks!

Did they automatically reschedule your N-400 after your I751 was approved? What did you do to get the second N-400 interview after I-751 was approved?
